上智大学での教授に対するハラスメントを止めさせよう!Stop the Harassment at Sophia University

**English Below**   概要 なぜ私たちは動くのか ・上智大学は長年間のパワーハラスメントやセクシャルハラスメント、そしてセカンドハラスメントまで隠し続けていたことが明らかとなったからです。クッキ チュー先生がひどく扱われていることを知り、他にも同じような経験をした教授は何人もいたことに愕然としました。私たちは現在、上智大学に起きている人権を及ぼす問題について、大学の改善を求めています。 TL;DR: ・Sophia University has a culture of silencing harassment and siding with the aggressors. Multiple professors (both inside and outside of Sophia) has reached out to us, describing similar instances of harassment.  ・Professor Choo applied for tenure a total of 4 times. She was accepted in her 3rd attempt, but the school retracted her tenure for unjust reasons. (Specifics below) She was denied tenure in her 4th application and the school rejected it without even evaluating it.  ——————————————————————————————— 上智大学は「インターナショナル」「リベラル」な大学であると主張しているのにも関わらず、教授に対して何年にも及ぶ酷いパワハラ、アカハラを行ってきたことが、最近明るみに出てきました。 クッキ・チュー先生は以前、米国の有名大学での永久職であった。だが、研究者として優れた業績を示したため、2年間で教授に昇進ができると説得され、2014年に上智大学の国際教養学部へ専任助教として転職した。5年以内に教授へ昇進すれば終身雇用されると彼女の契約で示されていた。チュー先生は終身雇用への就任を4回申請しましたが、これまでのところ学部の理不尽な理由で昇進を撤回されてきました。  昇進撤回の理由として国際教養学部が上げたのは: ・病気にかかった家族のためにアメリカに一次帰国したのは、その病気(ガン)がさほど深刻ではないから「緊急性がない渡航」であると言われ、休んだ授業分の補講も行ったにも関わらず「30日以上の無断欠勤をした」と決められた。この30日以上の期間には2週間である冬休みも含まれていた。  ・昇進の条件である論文を既定の数以上に提出したのに、「論文の数が足りない」とされた。   またハラスメントの一部として: ・「嘘つき」、「とろい」と罵られた。 ・「家族の病気が本当なのかを証明するために、病院で寝たきりの家族の写真を撮ってこい」と言われた。 ・いじめは「学部の文化だから我慢しなさい」と言われ、「大学に学部のハラスメントを報告すると昇進に影響を及ぼす」と言われた。 ・「訓練されてる犬だ。我慢しなさい」と言われた。 ・数年間、廊下とエレベーターで会っても無視をされる。   など人権侵害ととれるさまざまな不当な扱いをチュー先生は受けてきました。 チュー先生は、2015年から上智大学のハラスメント相談窓口に、国際教養学部におけるパワーハラスメント・アカデミックハラスメントについて報告してきました。さらに、この問題を解決するために上智大学のハラスメント対策委員会に救済申請もしました。しかし、ハラスメント対策委員会は、提出された音声録音などの証拠を丁寧に聞いたり検証したりすることなく、チュー先生が訴えてきた学部のハラスメント行為を、「ハラスメントに該当しないものと判断する」と結論付け、その直後に上智大学はチュー先生へ事実上の解雇通知を出しました。 上智大学はハラスメント問題に向き合って解決することより、チュー先生を追い出すことにしたのです。 またこの件について取材をしていた上智新聞編集局にも、学校は圧力をかけ、新聞記事を書かせないようにしました。「リベラル」な上智大学は学生を脅し、教授の人権も無視することに決めたのです。 ハラスメントが横行するような環境は健全な学び舎とは言えません。上智大学が本当に学生のことを思うのであれば、私たちの意見に真剣に向き合うべきです。 特に、チュー先生は、女性や人種マイノリティー、そしてLGBTQの権利などに真剣に取り組み、上智大学生が学内で安全に学業に邁進できるよう精力的に努めてきました。彼女は、性的暴力、いじめ、嫌がらせなどを受けた上智大学の学生たちを助け励まし、困難な段階を乗り越える手助けをしてきました。上智大学で、チュー先生ほど熱心に学生の成長、発達および保護に努める教員を他に見つけるのは非常に難しいでしょう。 学生たちはチュー先生の授業を通し、本当の「リベラルシンキング」とは何か、上智大学が掲げる「他者のために・他者とともに活動する」とはどういう意味なのかを学んできました。チュー先生ほど学生を思い、学校を思い精力的に活動してきた先生を失うのは学生、大学にとっても多大な損害となりえます。 これまでたくさんの学生がチュー先生の授業を取るのを待ち望んでいたのに、学校のハラスメントにより、学生たちの学ぶ機会・権利まで奪われてしまったのです。 以上のことを踏まえ、私たち在校生・および卒業生は以上のことを大学に求めます: 1.チュー先生に起きたことはハラスメントであると認め、責任をとること。 2.チュー先生に、取り消された終身雇用権を返し、学生たちが彼女の授業を受講出来るようにすること。 3.学生たちに脅しをかけ、怖がらせたことに対する誠意のある謝罪をすること。 4.大学内で、教員・職員すべてのものにハラスメント防止のレクチャー且つシンポジウムなどを行い、二度とこのような事が起きないように努めること。    チュー先生のハラスメントケースは例外ではありません。世界各地の大学教授や学生たちから、上智大学や他の大学で同じようなハラスメント被害にあったという連絡も受けています。これは深刻な問題であり、上智生として恥ずかしいことです。 どうか、私たちがこれからもハラスメントのない安全な環境で、意味のある教育を受け続けられるように署名活動にご賛同をよろしくお願いいたします。 ——————————————————————————————— There is an ongoing ‘culture of silencing harassment’ at Sophia University. Contemptible behavior such as harassment should not occur anywhere, especially at one of the leading global universities in Japan. Yet recently, it was revealed that a professor at Sophia University has been severely harassed by other faculty members of the Faculty of Liberal Arts Department (henceforth FLA Department).  In 2014, Professor Kukhee Choo was persuaded to leave her permanent position at one of the top 50 universities in the United States to join Sophia University’s FLA Department. She was told that she could go up for tenure in 2 years owing to her publications and accomplishments. However, despite having applied for tenure 4 times in the past 5 years, Professor Choo has not been given tenure. The condition of her contract with Sophia states that she must receive tenure within 5 years to become a permanent employee. Professor Choo applied for tenure 4 times within the past 5 years, and has been rejected 3 times, and has had one retraction. The reasons for the 3 rejections were always contradictory to the facts. Professor Choo’s 3rd tenure application was actually approved by the FLA Department in November of 2017. However, this promotion was later withdrawn in February of 2018. The basis of this retraction included more contradictory explanations, such as an accusation of 'more than 30 days unreported absence' during a prior winter travel and then an alleged lack of publications. In reality, Professor Choo followed necessary procedures for her winter travel, and is one of the most prolific research publishers in the department and submitted more publication than what was required for promotion. Professor Choo’s 4th tenure application was never even considered for evaluation.    Other forms of harassment include: ・Being told to submit a picture of her family member in their hospital bed to prove that her family member was really ill. ・Being labeled a liar and "slow" in learning the hierarchical human relationships of the department (she did not know who to curry favor with), and therefore, could not get tenure.  ・Being told that the bullying was the department’s ‘culture’, and thus something she had to accept, and that if she were to report the harassment to the university, her promotion would be affected.  ・Being told, “You’re a dog in training" and that she had to put up with the bullying to get tenure. ・Being ignored at the hallways and elevator by her colleagues for years.   Professor Choo has been consulting with the Sophia University Harassment Committee since 2015 regarding the ongoing power and academic harassment in the FLA Department. She has also reached out to the Harassment Countermeasures Committee to resolve this problem. However, without checking the submitted evidence, the Harassment Countermeasures Committee concluded that “none of the acts constitute harassment" and soon after, the university terminated Professor Choo’s employment. From this it is clear that Sophia University has decided to ignore their problems.  Sophia University has also made efforts to suppress the voices of students who hoped to shed light on the harassment against Professor Choo. The Sophia Times Newspaper attempted to raise awareness of the harassment on campus to the general student population, and have interviewed a few FLA students. However, the Center of Student Affairs Office not only threatened the The Sophia Times Newspaper, but censored their article as well. (On a separate, but related note, this is not the first time Sophia University has taken the side of the aggressors. On June 20th, 2019, a symposium titled “For a Campus Without Sexual Harassment/Sexual Violence ~Suggestions from Students~” was held at Sophia University. At this event, the representative of Sophia University, again from the Center of Student Affairs Office, made some problematic remarks. He defended the actions of sexual harassers when he said “I still think that understanding the perpetrator is also extremely important.” Making such comments defending rapists in a room full of rape victims is not only extremely inappropriate, but alarming.) In short, Sophia University has created a culture of silencing the victims of harassment, their supporters, and those who fight against harassment. We are calling for support to end this vicious cycle of perpetuating harassment at Sophia University as we, the students and alumni of Sophia University FLA Department, stand by Professor Choo’s account. From the perspectives of both current and former students, it is undeniable that Professor Choo in the FLA Department is one of the most valuable professors at Sophia University. Students who have taken her classes can attest to the quality of her teaching and course content. All of her courses range from historical and sociological perspectives on media & film culture, gender & race, and critical thinking. They all provide a truly global perspective, as the courses offered at Sophia University should. Professor Choo also promotes an open and dynamic environment that engages students in active discussions, which prepares students to be confident in participating on the global stage.  Professor Choo has also been an active protector of women’s rights, LGBTQ rights, and students’ safety on campus. She has helped Sophia students who were sexually assaulted, bullied, and harassed, and has guided them through their difficult times. We believe that Sophia University would be hard-pressed to find a professor as dedicated and passionate in the growth, development and protection of their students as Professor Choo is.  The denial of harassment against Professor Choo by Sophia University has reached the point that students had no choice but to rally in front of the school to bring attention to the truth of what is going on behind closed doors. Professor Choo’s case is not unique. We have received messages from professors and students all around the world who have had similar experiences at Sophia University as well as at other institutions.  This is why it is urgent to act.   What we aim to do through this petition ・Have Sophia University and the FLA Department recognize and address their ongoing harassment issues. Denying harassment goes against Sophia University's ideal of "recognizing the dignity and fundamental human rights of others” as stated on the university website. ・Have Sophia University continue Professor Choo’s employment. Her employment is not only the matter of the professor herself and the school, but also the students’ opportunity to learn more about the various social issues going on around the world. Only after learning about these issues can we students follow Sophia University’s philosophy, "Men and Women for Others, with Others." ・Have Sophia University and the FLA Department recognize that it has threatened the students, and apologize for it. ・To prevent a case like this from happening again, we urge the school to hold a symposium against harassment for all members, students and faculty, within a university.   By signing this petition, you pledge your support to put a stop to Sophia University’s culture of silencing harassment as well as the unfair removal of Professor Choo, to shed light on this harassment issue, and to work to prevent it from happening again in the future. Much like the #MeToo movement and Hong Kong protest abroad, change can only happen when enough people see the unfairness and speak out against it. Students' voices matter, and it is the duty of the university to provide the high level education that they promised. Please support our petition to protect current and future professors from harassment and to protect our quality of education at Sophia University.

Stop Workplace Bullying by CEO Douglas "Doug" Badertscher, Sarasota Orthopedic Associates

Did you know that at the age of 37 you can still be bullied? Did you know that Florida doesn’t protect its employees from workplace hostility or bullying? What if that bully was the CEO? Unfortunately, this is why I’m writing this petition.  I would like to emphasize that this is not about the care the physicians at SOA give their patients. The SOA physicians are very good at what they do. I would send my own family to get treated by them.  This petition is to reach out to the Managing Partners of SOA, Dr. Jeffrey Silverstein & Dr. Gregory Farino. Please hear us and do not dismiss the facts that are being given to you. Douglas Badertscher, CEO running your company is causing harm.  He has created a hostile work environment in terms of bullying, intimidation, verbal, emotional and mental abuse. He resorts to fear management, stalking employees personal life and threats by using the company legal team. His abuse is well known and not a hidden secret. Please help create a healthy work environment for the employees that work hard for you and want your practice to succeed. Please make this change.  The physicians, employees, and managers who run SOA daily are really good people, empathetic and hard working. No one deserves to work in an abusive environment. I know you care but may not know how to proceed. Stand next to the people who really run SOA. All current and past employees... deserve better.  You both can change lives and make a difference.   Ask yourself this Dr. Silverstein & Dr. Farino...would you want your children treated the way we have been treated by this bully? You would be appaled if they were. *********************************** To all who are reading this please stand with me. I resfuse to be silenced by threats and intimidation.  My story below... I’m 37 and I experienced intimidation, hostility, stalking, (yes stalking) bullying and had to resign from my recent place of employment because of this. Actually, it’s called “constructive discharge” look it up. On September 19, 2018 I had no other choice but to resign from SOA.  I have a past that continues to haunt me. I informed all those that needed to be informed including the CEO. I stated clearly to that CEO that I suffer from depression, anxiety & PTSD and I hit rock bottom because of this and was grateful for my current job. He proceeded to do the following for 2 Days, 3 meeting total: 1. Stalk my personal information, called people to do his own investigation.2. Pulled up all of my past info, made me sit for 1.5 hours to interrogate me. 3. Accused me of all wrong doing. 4. Did not stop his verbal/mental/emotional abuse when I asked him to “please stop”5. I had a full blown panic attack and he had me removed from the office no pay because of #4 and the panic attack. 6. I filed a formal HR complaint, HR was present the entire time anyway... nothing happened. 7. I reported to the Managing Partners...nothing happened. 8. I then received, emails, FedEx overnight letters to threaten, intimidate and silence me. Sent by their lawyers. All of this interrogation and intimidation happened in two days!!! It was a horrifying experience that HR even advised me to resign because he was certain I would be called in to be interrogated and intimidated daily. So, I resigned. I reached out to a minimum of 20 law firms...because I was certain this was not right. Right? I was wrong. This morning I spoke to the only lawyer who believed me, who did extensive research because it’s people like this CEO that motivates him. “I did nothing wrong as their employee,” he said. I actually did everything right...but Florida as stated by this lawyer is “pro employer and 40 out of 50 states should have a law to protect me...Florida is not one of them.” This lawyer, has known about this CEOs reputation and just like me...wanted to stop him from continuing to abuse more employees. It was disheartening to hear that this morning. This is out of my control and I don’t have our law to protect me. I’m writing this because I refused to be silenced and to allow the continued bullying. If I stay silent...then I’m complicit. I refused to be intimidated by a CEO, by a man, by managing partners who are also men...that refuse to protect their employees.... mostly female. It’s disappointing to continue to see these “partners” look away and allow him to rule with fear & intimidation. It’s very sad that the recent #metoo movement doesn’t include this. And by no means am I comparing the two...but I thought we now lived in a world where we could fight for protection from all types abuse. Let’s not forget that bullying & intimidation is destructive even for adults too. And as adults we are active participants of this. So please be mindful. Google it...there’s more if it than we’d like to acknowledge. I was never bullied as a kid. But as an adult it happened more than I’d like. It happened to me recently. Im smart, Im easy going, Im a hard worker, I’m kind, Im a fighter and I was bullied. He has silenced many... I refuse to be one of them. I’m 37 years old...
