¡Ayúdanos! Mis hijos y yo hemos sido víctimas de la Fundación Filia de Amparo.
No dejes que esto pase a ninguna otra. Es temerario e irresponsable que esta práctica no esté homologada en España y que haya polémica sobre su intervención en procesos judiciales. ¡ Ya Basta, con el apoyo del dinero público! Sus informes son determinantes para quitar la custodia de los niños a sus padres. Según el periodico El Español.
El servicio de intervención de coordinación parental de la Fundación Filia se ha excedido en las funciones que tiene encomendadas, atacando mi honra y reputación como persona y madre. El Informe que ha elaborado esta fundación sobre nuestro caso (informe que adjunto), debía realizarse según lo que se transcribe del Auto del juez (se adjunta documento), esto es: “con el fin de que la unidad familiar se someta al programa de terapia familiar con el fin de evitar la ruptura de los menores con su padre” ( tal y como prevé en el punto 4° “Objetivo de la intervención” del informe). La fundación Filia se ha mostrado irresponsable y negligente en sus funciones.
Ha demostrado un abuso de poder hacia nosotros, intimidando a mis hijos diciéndoles cosas como: “Aquí mandamos nosotros” y a mi hija menor de edad y víctima de violencia de familia le han dicho: “¿No sientes pena por tu padre?” También no han tenido en cuenta nuestros sentimientos y nos han tratado de manera despectiva desde el principio. En una ocasión, llegando incluso a comparar nuestro caso con el de otra mujer, indicando que ella había sido víctima de violencia de género porque tenía pruebas de abusos físicos e insinuando que nosotros no lo éramos.
En el informe, la credibilidad que se da al progenitor se basa en todo lo que dice sin cuestionar ni contrastar ninguna de sus afirmaciones. Esto, en comparación con el trato hacia mi persona en el informe muestra una falta total de objetividad y parcialidad. Hay documentación que prueba que el progenitor ha estado acosándome y maltratando verbalmente, incluyendo correos electrónicos del progenitor.
El informe es completamente unilateral dedicando 31 líneas al padre y a la madre 16. Se da credibilidad exclusivamente a las palabras del progenitor y se ignoran las circunstancias que han llevado a la familia a esta situación. Es también contradictorio cuando dice: “La progenitora mantiene una actitud inestable durante todo el proceso,” a pesar de que al principio del apartado se dice que se ha mostrado educada y dispuesta a colaborar. Y ofensivo e incierto al decir: “mostrando una actitud ofendida, y pensando que todos van contra ella, que hablan mal de ella, incluso que se ríen de ella.” Son todas afirmaciones negativas hacia mi sin embargo son las palabras literales del progenitor porque él solía decirme esto atacándome y humillandome verbalmente en casa. Muestran mala práctica con acusaciones e injurias sin pruebas ninguna. Cuando se refieren a mí insinuando que, “podría incurrir en un delito de sustracción de menores” aunque no dan ninguna prueba. Además los niños no tienen pasaportes, porque el progenitor lo prohibió.
Ha sido un evidente atentado contra mis derechos y los de mis hijos. Ha consistido en acusarme de inferir en las relaciones paterno-filiales. Haciendo que nuestro testimonios quedan desacreditados en el proceso judicial a favor del progenitor. Han mostrado una falta de interés hacia los sentimientos de mis hijos siendo forzadas a ir al centro; ellos no quieren ver a su padre. Sus acciones son inexcusables en su deber de protección del menor; pues con este informe mis hijos podrían quedar irresponsablemente desprotegidos frente a un progenitor que está en un proceso de violencia de género; proceso que no se nombra en todo el informe.
Tampoco se ha tomado en consideración nuestro sentimientos de inseguridad, temor y evidente desvalor motivado por el progenitor, quien está denunciado por violencia de género y cuyo procedimiento penal se mantiene vigente. Además en más de una ocasión coincidí con el progenitor en las instalaciones de la fundación porque no se preocuparon de que esto no sucediera. Esto era muy estresante para mí y los niños que ya entrábamos con mucha ansiedad a las sesiones.
El informe alude a la salud mental de la progenitora y de los menores, mostrando falta absoluta de profesionalidad y excediendo lo que se recoge en el Auto como objeto de esta intervención; no es este el cometido que tiene este servicio ni cuenta con profesionales que puedan diagnosticar ningún tipo de trastorno mental, no pudiendo entrar a concluir ni valorar la necesidad para ningún progenitor o menor de atención en salud mental (conclusión VI del informe).
Como se refleja en el informe, desde esta fundación, se han mantenido conversaciones con mis vecinos, los cuales no tienen nada que ver con la unidad familiar ni son un mecanismo útil para la finalidad pretendida por el juez. Los comentarios de los vecinos no eran más que habladurías sin ninguna prueba, lo que muestra falta de ética, profesionalidad e irresponsabilidad social. No tuvieron en cuenta que el progenitor había estado en contacto continuo con los vecinos, como él mismo indica en varios correos electrónicos.
No han respetado que mi idioma materno no es el español, no facilitándome las sesiones en mi idioma o al menos ayudándome, y aunque traje a alguien para ayudarme con el español, también me lo han negado. Ello ha derivado en que yo no entendía bien y que no sentía que me comprendieran, tampoco me trataron con paciencia en ningún caso.
Han sido poco profesionales citándome fuera de la fecha del contrato con ellos como indican en el parte III/ Periodo De La Intervención: “La Intervención habrá de desarrollarse en un periodo de TRES MESES”; porque me seguían obligando a venir sabiendo lo estresante que era para mí salir del trabajo, sin darme facilidades de otros horarios para las sesiones. Una vez me obligaron a ir sólamente para calificar sus servicios. Creo que la mala calificación que les di en la última visita, influyó directamente en su informe. Usaron métodos manipuladores y coercitivos para tratar de hacerme hacer cosas con las que no me sentía cómoda relacionadas con el divorcio, que no es de su competencia; incluso con el tema de la venta de la casa

Stop the Intervention of the Fundacion Filia in the Judicial System!
My children and I have been victims of the Fundación Filia de Amparo Foundation. DO NOT LET THIS HAPPEN TO ANYONE ELSE! It is reckless and irresponsible that this practice is not regulated in Spain and there is controversy over its intervention in legal proceedings. Stop funding it with the support of public money!
Why is Fundación Filia not monitored in Spain? Their reports are decisive in removing the custody of children from their parents or influencing it.
The parental coordination intervention service of the Filia Foundation has exceeded the functions entrusted to it, attacking my honor and reputation as a person and a mother. This report had to be made according to what is transcribed from the Judge's Order (document is attached), that is: "in order for the family unit to submit to the family therapy program in order to avoid the rupture of the minors with their father” (as provided in point 4 “Objective of the intervention” of the report). The Filia Foundation was irresponsible and negligent in its duties.
In the report, the credibility given to the progenitor was based on everything he said without questioning or testing any of his claims. This, in comparison with the treatment of me in the report, shows a total lack of objectivity and bias. Documentation and various audios prove that the progenitor had been psychologically and emotionally abusive. As well as harassing and trying to scare and intimidate me by email.
The report is completely unilateral, devoting 31 lines to the father and 16 to the mother. Credibility is given exclusively to the words of the parent and the circumstances that have led the family to this situation are ignored. It is also contradictory when it says: "The parent maintains an unstable attitude throughout the process," even though at the beginning of the section, it is said that she has shown herself to be polite and willing to collaborate. And offensive and uncertain when saying: "showing an offended attitude, and thinking that everyone is going against her, that they speak ill of her, even that they laugh at her." They are all negative statements towards me however they are the literal words of the progenitor because he used to tell me this by attacking and verbally humiliating me in the home. They show malpractice with accusations and insults without any evidence. When they refer to me insinuating that, "I could commit a crime of child abduction" without any proof. In addition, the children do not have passports, because the progenitor forbade it.
Their report has deliberately attacked my rights and those of my children. It has consisted of accusing me of interfering with the parent-child relationships and discrediting our testimonies in the judicial process in favor of the aggressor. They showed a lack of interest in the feelings of my children being forced to go to the center. They don't want to see the progenitor because of the abuse. Due to their report, my children could be left irresponsibly unprotected the custody could be reversed and given to a parent who is facing domestic abuse charges which is not named throughout their report.
The Fundación Filia demonstrated an abuse of power, intimidating my children by saying things like: "We are in charge here" and they asked my underage daughter, a victim of abuse: "Don't you feel sorry for your father?" They also disregarded our feelings and treated us in a derogatory manner from the beginning. On one occasion, they even went so far as to compare our case with that of another woman, indicating that she had been a victim of gender violence because she had evidence of physical abuse and insinuating that we were not.
They never took into consideration our feelings of insecurity, fear, and obvious worthlessness motivated by the progenitor, who has been accused of gender violence and whose criminal proceedings are still ongoing. In addition, on more than one occasion I met the parent at the foundation's facilities because they did not worry that this would not happen. This was very stressful for me and the children who already entered the sessions with great anxiety.
The report alludes to the mental health of the parent and minors, showing an absolute lack of professionalism and exceeding what is included in the Order as the object of this intervention; This is not the role of this service, nor does it have professionals who can diagnose any type of mental disorder, and it cannot conclude or assess the need for mental health care for any parent or minor (conclusion VI of the report).
As reflected in the report, conversations have been held with my neighbors, who have nothing to do with the family unit and are not a useful mechanism for the purpose sought by the judge. The neighbors' comments were nothing more than gossip without any proof, which shows a lack of ethics, professionalism, and social irresponsibility. They did not consider that the father had been in continuous contact with the neighbors, as he indicates in several of his emails.
They did not respect that my native language is not Spanish, and they did not facilitate the sessions in my language even after I requested it, even though I brought someone to help me with Spanish, they denied me. This has led to the fact that I did not understand well and that I did not feel that they understood me, nor did they treat me patiently in any case.
They have been unprofessional, quoting me outside the date of the contract with them as indicated in part III / Period Of The Intervention: "The Intervention will have to be carried out in a period of THREE MONTHS"; because they kept forcing me to come knowing how stressful it was for me to leave work, without facilitating for other times for the sessions. Once they forced me to go just to rate their services. I am sure that the bad rating I gave them on the last visit directly influenced their report. They used manipulative and coercive methods to try to get me to do things that I didn't feel comfortable with related to the divorce, which is not within their purview; even with the subject of the sale of our house.
Use of the term "syndrome" P.A.S. has not been accepted by either the medical or legal communities and Gardner's research has been broadly criticized by legal and mental health scholars for lacking scientific validity and reliability.
