Please help stop the destruction of the small harmless beach tree house on Anna Maria Island. Help stop the conflict over hundreds of pages of state laws and city codes. Help preserve a work of art that thousands have liked and petitioned for. But most of all, help preserve our rights to peaceful enjoyment of nature on our private land.
We were told that there are no codes for tree houses and that no permit is required by the city officials in the spring of 2011. So we built it with good faith reliance on the words of the officials. The tree house is built as a 2 level deck. Then 2 years later, April 2013, the city backtracked, commanded us to demolish our tree deck or come into compliance with numerous impossible and inapplicable codes, and fined us $100 per day even while we appeal in court.
Legal has determined that per state law, the tree deck may be exempted from permitting requirements. We are willing to get an after the fact permit but the city refused to give a permit until we relocate the tree and the tree house to meet city codes. We cannot relocate the tree and tree house without killing the tree and removing the tree house. So we started a petition as allowed per city codes, but after we gathered all the required signatures, the city filed a lawsuit claiming that we cannot petition as state law prohibits it. We have spent over $100,000 including several court filings, to protect it from destruction, to protect our property and our rights, and to seek justice.
We are in need of your support and help. We believe in creating beautiful things and to spread love and happiness. We cannot voluntarily destroy the tree house without trying everything we could.
Please help save the tree house and preserve our property and constitutional rights.
