ICE (Immigration and Customs Enforcement) took Edgar Ortega into custody on February 11, 2013 and is currently deciding whether he will be deported to Guatemala or granted a stay of removal. Edgar has been in the U.S. for 14 years and lives with his family here, including his wife and his two young children who were born in California. He has a pending immigration case at the United States Court of Appeals for the Ninth Circuit, but the appeals court does not provide any automatic protection to stop ICE from deporting people in Edgar's situation who are awaiting a decision.

From Edgar's wife: “Edgar and I love each other and our children deeply . . . our two children are both very young and do not understand what is going on. At their age, their father’s consistent presence is vital to their emotional and mental growth. If their father remains absent from their lives after a sudden disappearance, this can have major long-term consequences on their emotional well-being.”

Delfino Gomez Gonzalez, a member of the church Edgar and his family attend, says that, “Edgar is an excellent, exemplary father. When he is not working, he spends all his time with his family. I can see that Edgar’s children are his priority in life. He does everything possible so that his children are happy. Edgar is a very reserved person, but he has a quiet strength and he supports our community. He is honest and hard-working, and I know that his family needs him and depends on him.”

If Congress passes immigration reform legislation, Edgar is likely to be included in the new path to citizenship, but if he is deported now, he may not be allowed to re-enter the U.S. to be with his family. Please ask ICE to suspend Edgar's deportation while the appeals court decides his case and while Congress works toward immigration reform.

      Edgar Ortega was deported to Guatemala today, despite our requests for a stay of removal and the support expressed by Congressman Jared Huffman, the Guatemalan Consul, and the thousands of people who signed this petition. Please tell Congress to provide a path to citizenship for the millions of foreign-born people who have built their lives here. Until we achieve immigration reform, ICE should be required to follow its own directives to meaningfully evaluate cases like Edgar's for prosecutorial discretion, so that governmental resources will not continue to be expended to separate families. As Edgar's lawyer, I will continue pursue his case at the Ninth Circuit Court of Appeals and do everything I can to help him be reunited with his family.       This morning, February 11, 2013, Edgar Ortega appeared in person to apply for a stay of removal to postpone his deportation at least until the Ninth Circuit Court of Appeals makes a final decision on his immigration case. ICE took him into custody and will decide during the next 2-5 days whether it will grant him a stay of removal or deport him to Guatemala. Please spread the word that more signatures on the petition will show ICE that it is in the public interest for Edgar's application to be approved, so that he can stay with his U.S. citizen kids while the Court of Appeals decides his case.

      If Edgar has been a kind asset to his community and family, I do not see why he should be sent out of the countrty. I believe our immigration laws are too strict. I believe we should offer loving families an opportunity to remain together in the US, if they are working and making a life for their family.

      Well my husband is on the same boat and we have 2 small children's as well ages 5 and 6 and he is in deportation removing and I don't know how they can tear this family's apart .We all work and we pay taxes in this contry just like others y destroy this life's .Im sorry that this family has to go through this .Good Luck !!!
