PETITION TO URGE GOVERNOR JERRY BROWN OF CALIFORNIA TO IMMEDIATELY RELEASE LOUIS BYRD

 

Governor Jerry Brown and the California Department of Corrections and Rehabilitation have been ordered by the federal court to immediately release 9,600 inmates from California's prisons. The California Department of Corrections and Rehabilitation might first consider the release of the sick and elderly. Louis Byrd is elderly and sick.

 

WHY LOUIS BYRD SHOULD BE RELEASED FROM THE CALIFORNIA INSTITUTION FOR MEN IN CHINO, CALIFORNIA

 

Louis Byrd is an eighty-one-year-old father, grandfather, great-grandfather, veteran of the Navy, former educator, principal, USC alumnus, and former councilman and mayor of the City of Lynwood, California for sixteen years. We urge Governor Brown to release Louis Byrd immediately as per the federal court's mandate. Louis Byrd is not a flight risk, and he will not contribute to an increase/surge in the crime rate.  Louis Byrd was denied bail pending his appeal because the trial judge said that he was a flight risk at eighty years old.

 

Louis Byrd is now serving a four year sentence at the California Institution for Men in Chino, California. We, the supporters of Louis Byrd, believe that he was unjustly accused, convicted, and incarcerated for the misappropriation of public funds. He is currently appealing the conviction, and we are confident that he will be exonerated. His case was prosecuted as a "test case" for the City of Bell.

 

Every day that Louis Byrd remains incarcerated poses a threat to his physical and mental health. His separation from his family and friends has been very painful. The time that he spends in jail can never be returned to this eighty-one-year-old man upon being exonerated.

 

THE FEDERAL COURT DEMANDS THAT GOVERNOR BROWN IMMEDIATELY BEGIN THE RELEASE OF PRISONERS

 

The federal and Supreme Courts have ruled that incarceration in California’s prisons violates the Eighth Amendment’s ban on cruel and unusual punishment. The severe overcrowding denies sick inmates good medical care. However, Governor Brown does not want to implement the court’s order; hence, the court has threatened to hold him in contempt of court.

 

We, the Committee to Release Louis Byrd, call on Governor Brown to show compassion to Louis Byrd and to others who are also low risk offenders and elderly and to order Secretary Dr. Jeffrey Beard of the California Department of Corrections and Rehabilitation to immediately release Louis Byrd from prison.

      Mayor Byrd was instrumental in my development as an elected official from Hayward, CA. His encouragement was key to my National League of Cities Chair of Public Safety position and subsequent member of the National Task Force on Interoperability. Mayor Byrd is one of the most honest and forthright electeds that I know. I find it extremely unlikely that he would commit this kind of crime. He certainly never suggested any sort of thing to me. In light of Bell and Vernon California, I find it curious that some of those deals include sentences tantamount to Mayor Byrd's. Curious considering ethnicities.

      louis byrd is my great uncle i love him dearly & i think it is crazy that my 80 year old uncle is facing 10+ years in jail for something he didnt do . uncle louis is a smart loving man & a great father & teacher as well as provider for are whole byrd family & others close to family i love him & i wish he wa here for xmas & thanksgiving .. yoou guys are keeping a innocent elderly man for NOTHING AT ALL FREE HIM !!!!!

      This man is an up right citizen and doesn't deserve to be in jail in his golden years. He has always represented well and is a family man as well.

      Mr. Byrd, was a mentor to my son, from Grade school to College, he served his neighbors and community as well as the nation. His humble personality and sincere concern for mankind is matchless. He picked my son up from the airport the day before his sentencing, because my mom had passed, and I didn't have any transporation nor shuttle money. He is not a treat to society. Release this man now. In Jesus Name.
