§21 844. Ordinary force as means of discipline not prohibited. 
Provided, however, that nothing contained in this Act shall prohibit any parent, teacher or other person from using ordinary force as a means of discipline, including but not limited to spanking, switching or paddling. 
Laws 1963 C. 53, Sec. 2 
This is the current law. This law means anyone can use ordinary force on ANY child, at any time. We would like this law reworded to uphold the rights of parents/guardian/or other custodial persons to be the only people legally allowed to discipline their children

Daygun’s Story

 

 Daygun was belted durring an Autistic meltdown and called names, while his sister was threatened to silence. Mom went to press charges, and found that she could not. For months Daygun would not talk except to ask his family "please do not hurt me" while his parents had nightmares and his siblings suffered in tears. All of this could have been avoided for us if our wishes had been followed and someone had not taken away our right to choose the manner and timing of discipline. 

 

We are demanding this law be reworded to say that only parents and guardians have the right to make those decisions. We want the right to press charges, just like we would if our adult person was assaulted in the manner a 4 year old special needs child's person was. We demand that child and parent relations be upheld under the law to provide the security of personal choice about discipline inside our homes and in the entire state of Oklahoma.

      Once again we have a chance to present Daygun's Story, this time at Rock for Autism in Springfield MO on August 30th. Please come if you would like to attend! We are hoping to inform other Autism parents that 1 in 3 special needs children are likely to become abused versus 1 in 10 children without special needs. No education was given to us with his diagnosis, and we were not aware of the risk he was facing. Join us at Nathan P Murphy's next Friday!

    2. April is the month!

      In April we will be traveling to Oklahoma City to lay this story before everyone. Some of you may know, April will see child abuse advocates at Federal and State capitols. We intend to take our place to see the loophole this law creates closed. It has never been our intention to remove the right of discipline from parents and guardians. We do, however, intend to see to it that these people be granted the only rights to determing what discipline means. If you would like to join us in person, by phone, or by email we would appriciate it. Without faces, without Daygun's face, the reality of the impact this law has on real lives will never be understood. Together we can help to protect more children by added a few words to a law. Wouldn't that be wonderful? We can see that come to life!

      Our event will be August 25th, in Rotary Park in Miami OK from 10 am to 4 pm. We will be handing out paper copies of Daygun's story, and the petition. If you can, please come. Invite friends. All the information is on the community site link below. If you live to far, please contact me and we will host our next event near your Oklahoma location. There is not any fundraising, nothing is for sale nor are donations going to be accepted. Signatures and talking about this law and it's effects is all we want. Please come and tell us how you can help! Bring the whole family, there is a nice park there for them.

      We are having a small issue getting paper copies of the petition. However, we will have wifi available to you and some laptops to use to sign the petition online if paper copies cannot be made. Thanks!

      I have PDD-NOS Autism Spectrum Disorder. Just like the other violations against the rights of Autistic individuals that I've learned about recently, this is shocking and painful. Only a doctor has a right to determine if Daygun has Autism or not, and this man's violation over the parent's right to determine proper disciplinary action is further agrivating in that his actions may have even set Daygun's progress back for possibly YEARS, and that is a serious a heinous act to even think abou committing.
