The Proposed 40b high density development at 6 Forest Road of 76 units is inappropriate and incompatible with the goals of the Town of Salisbury as stated in it's Housing Production Plan. This high density development would put a huge strain on the town's traffic, police and safety infrastructure as well as its already overburdened water supply, and other services.  The Zoning Board of Appeals has the power to deny this permit with no recourse, and maintain the zoning that has been carefully planned by our towns officials and approved by our citizens at town meetings.   

Massachusetts 40b law states that once a city or town reaches the 10% subsidized housing inventory the towns ZBA board can overrule the state to take back control over the existing zoning, and not be bulldozed by the comprehensive permitting process 40b.  Salisbury has been more than accommodating to affordable housing.  We are currently over the 10%.   It's important to keep the power in the hands of the people who are looking out for the citizens of our community, and not the state who will completely disregard our zoning bylaws.  We feel that approving this permit will lead to future high density 40b's in neighborhoods that do not support them or are not zoned for them.   This will set a landmark precedence in our town that will be a case study for many projects to come.  Considering we are in "Safe Harbor" at over 10%.  The town has worked incredibly hard to reach the 10% goal for this very reason.  This decision will greatly affect anyone who has invested in a home zoned for medium to low density use in town.

We strongly encourage the Salisbury Zoning Board of Appeals to deny the comprehensive permit 40b for 6 Forest Rd, LLC.  If approved under any imposed conditions the builder has the leverage to go back to the Housing Appeals Committee of Massachusetts and prove that the conditions imposed on the project are uneconomic (case studies show this is easy to prove).  This will erase all of the work done by the board to reduce the project's size and impact.  We urge the builder to come back to the table with a proper building plan for the neighborhood with affordability like others that have just been built on Forest Rd and Gerrish Rd.  Massachusetts General Law Chapter 40b has been misused by builders to maximise profit for many years, and is one of the most controversial laws in the state.  This is a money making machine that is a bulldozer to local zoning codes.  There is no reason to approve a 40b while in Safe Harbor its detriments far out way its benefits to the town.  If you live in Salisbury please sign our petition to help the ZBA board know how we as citizens feel about projects of this size and impact.
