Marcos Cortes was a finalist in the YFU, Congress-Bundestag Exchange program, which would allow him to go to Germany for a year to study the German language and culture. Marcos is a honors student with a bright future, but he also happens to battle with anxiety. He was selected after a lengthy written application and an interview. Unfortunately, he was going through the stresses of his senior year, and worse yet, coming to the realization that he may not see some of his friends again after graduation was over. On graduation day he had an anxiety attack and told YFU about the occurrence. They had known about his anxiety; he had not had an attack in quite some time, his doctor even told him he no longer needed his medication, so they didn't find it concerning. Once he told them about his anxiety attack and that he planned to start taking his medication again, on June 28th he was called by YFU. He was told after a tough decision made after speaking with YFU Germany, and the state department, he was no longer going to be a participant in the program, as they feared his anxiety would damage his well-being while abroad. They told him this news only a month prior to his departure, negatively affecting him. Making a decision on what college to go to based solely on this program, planning to continue German throughout his college career, and having to tell all of his friends, family, and his future host brother that he would no longer be able to compete in the program were the consequences of YFU’s one–sided decision. He was unable to receive the opportunity to appeal YFU’s decision because the board had already decided. He was not allowed to speak to a supervisor or an employee of a higher position about this decision.
Marcos Cortes is an example of Anxiety Discrimination. He was unable to properly defend himself and we believe the Americans with Disabilities Act can be applied to how this case was treated. Through this petition we hope that he is able to appeal YFU’s unethical decision and receive his opportunity.
