The overturning of Roe V. Wade is grossly negligent on behalf of the U.S. Supreme Court by infringing upon a women's right to privacy and autonomy that is federally protected under the 5th amendment: Amdt5.4.6 Substantive Due Process; Amdt5.4.6.10 Health Care Autonomy, Amdt5.4.6.11 Equal Protection, and Amdt5.4.6.9 Privacy ."Liberty" although not well defined within the constitution is "the state of being free within society from oppressive restrictions imposed by authority on one's way of life, behavior, or political views" as such, this is the most an egregious overreach of our liberty by our Government in half a century. There are no known procedures that force a man to undergo a healthcare related procedure against his will; except in the cases of chemical castration and the death penalty but this is after a court conviction has stripped away his constitutional rights. If birth can be enforced, abortion can be mandated by the state under the protection of federalism. Where the constitution protects our liberties and where it doesn't is currently unclear as a result of this overturning. Women are now 2nd class citizens who do not have the right to the same bodily autonomy as men. Under the Federal Tort Claims Act civilians can sue the Government for failure to act appropriately. A tort is defined as “a wrongful act or an infringement of a right (other than under contract) leading to civil legal liability". By overturning Roe v. Wade, the U.S. Supreme Court is legally liable for any bodily harm resulting from a woman's lack of access to healthcare. In addition, it can be argued that the overturning of Roe v. Wade is a failure to act appropriately and the entities responsible can be sued under within this context.
