The Joint Regional Planning Panel (JRPP) considered the Developement Application(DA) 1774/213 at Dudley Rd, Dudley at length in 2015. One of the conditions of consent was the removal of the fourth storey on the mixed-use building fronting Dudley Rd , Dudley.
SNL (Developers) have submitted a NEW DA 131/2018 that is in effect trying to reinstate the fourth storey that the JRPP ruled against! This new DA is in effect a 'variation' on what the JRPP approved and is not a new proposal. the subject building is not "EXISTING", it is still to be built.
The Panels determinations removed the 4th floor dwellings and limited the number of dwellings to 89 (down from 92) in 2015. SNL Building Constructions Pty Ltd and SIMHIL Living Pty Ltd should not be allowed to now ADD an additional storey and exceed the height limit of 10 metres by up to 43%of this building facing Dudley Rd 3 years later.
If this DA is approved it can set a precedent for other developements in Whitebridge, Dudley, Redhead....other concerns include: the significant height exceedances; an intensification beyond stated expectations for this site; the continued push by a private developer to set the sense of place for a neighbourhood in violation of the community’s sense of place; and the pressures of this DA on visual aspects and parking and traffic concerns, And finally, it is because this new DA contains a direct request to overturn key conditions set by the JRPP that all those who submitted last time should be alerted now by LMCC.
