UBER & Lyft / TNC's coming into Westchester
As you may or may not know, Uber / Lyft and any Transportation Network Company (TNCs) will be able to legally operate in Westchester County effective June 29th, 2017. New York State, thanks to Governor Cuomo, passed the bill allowing TNC’s or “ride – hailing” companies, to operate outside of New York City using their personal vehicles and non-commercial driver's license while working.
This Monday, June 19th, there is a “Public Safety Committee Meeting” at 10:00am. In attendance to speak will be representatives from the Westchester County Taxi & Limousine Commission, Public Safety Department & Budget Committee. The topic of discussion is “Ride Sharing in Westchester”, aka; UBER & Lyft. At this meeting, the speakers will be informing the committee on what we can expect to gain / lose when the TNC’s begin legally operating in Westchester. I hope you all agree, that if ride sharing companies want to legally operate in Westchester, they need to follow the same rules and regulations that we have been following under the guidelines of the Westchester County Taxi & Limousine Commission.
Although this is an open to the public meeting, we are not allowed to speak, however that evening at 7:00pm, there is a full board meeting of all 17 Westchester County Legislators. At this meeting, although they are not voting, one of their topics of discussion will be UBER/Lyft. WE as the public, are allowed 3 minutes per person to voice our concerns. I strongly suggest you attend both meetings as this may be our last chance on educating the County Democrats as to why we need to “Opt Out” in Westchester. “Opt Out” means, if a TNC wants to operate in Westchester, they must follow the rules and regulations set forth by the W.C.T.L.C. We need to make our voices heard!

Additionally, we need to write and/or call our County Legislator and voice our concerns prior to next Monday. For those who do not fully understand our side, it is extremely important that those legislators, not fully informed, have time to read and digest the issues at hand. Hitting them all at once at the Board Meeting may not be as effective. The combination of the emails or phone calls AND attending these meetings I believe will help our cause that much more. Remember, our County Legislators are the ones who can “Opt Out” in Westchester, thus forcing the TNC’s to operate under the same rules and regulations that we have operated under since the WCTLC was formed almost 20 plus years ago. If you’re not aware, the TNC’s in any of the NYC boroughs have to operate under the rules and reg’s of the NYC Taxi & Limousine Commission. The same should apply to Westchester. I can’t predict what will happen if the TNC’s are allowed to operate under the new law as it stands now, but my guess is the W.C.T.L.C. will cease to exist and the Department of Motor Vehicles will regulate our industry. We already how easy it is to deal with the DMV!
In your emails or phone calls, there are some key bullet points outlined below that should be included when communicating to your local legislator.
The primary mission of the Taxi & Limousine Commission is the protection of the riding public. As such, below are a few bullet points to bring up when communicating with your local legislator:
· TNC drivers must be required to have a thorough fingerprint-based background investigations through the Division of Criminal Justice Services (DCJS)
· TNC drivers must take a yearly drug and alcohol test
· TNC drivers must take a Defensive Driving Course every 3 years
· yearly renewable Chauffer’s License
· yearly renewal, specially marked limo plates
· pay the same county taxes which average 8% across the county, not the 4% state sales tax that Uber is currently paying
· We can’t stop the TNC’s from operating in Westchester, but under the new current state law, if unopposed, the TNC’s will have an unfair and non-level playing field vs. our local for-hire vehicle companies.
· Let’s not forget the new guidelines for picking up at LaGuardia Airport, Terminal “B”. All black cars have to pick up at the designated passenger pickup area. Without TLC plates, what’s to stop them from picking up at Terminal “B” if they are going back to Westchester?
· Let’s also not forget that Uber/Lyft does not meet their drivers. Remember Bob Simon of CBS’s 60 Minutes who was killed in 2015 in a fatal car accident, driven by a one armed UBER driver.
