House Bill 4393 Title 61

61-30-3

Amend the "Dangerous and Wild Animal List" for House Bill 4393 Title 61: 61-30-3

You can read the proposed rule in its entirety here: http://apps.sos.wv.gov/adlaw/csr/readfile.aspx?DocId=25971&Format=PDF

The Dangerous Wild Animals Act, passed as a bill in West Virginia, is intended to decrease instances of injury and death to humans caused by "dangerous animal" as well as decrease the environmental cost of escaped species that are considered to be invasive.

However, the list of "dangerous and wild animals" released by the board has some glaring oversights as to what would be constituted as "dangerous." There is a 30 day public comnent period that ends on August 1st of 2014.

Any individual owning an animal on the list would be required to pay a fee of $100 PER animal PER year.

Some of the preposterous oversights on this list include but are not limited to:

ALL clawed frogs
ALL tree frogs
ALL toads
ALL turtles
ALL trigger and puffer fish
Over 2,000 species of gobies
ALL tetra fish

Restrictions include:
Certain hamsters, mice, and rats
Rabbits
Sugar gliders
African pygmy hedgehogs

While some of the animals listed are reasonably listed, such as crocodiles, elephants, and many animals you would only see in zoos (giraffes, rhinoceroses, etc.), the fact remains that many of the animals listed are tropical species that could not survive in our environment were they not kept in captivity.

Not only does this have a strong impact on reptile and aquarium hobbyists across West Virginia, but the impact on small, family-owned pet shops would be devastating to say the least. Many small businesses rely on these exotic (exotic, not dangerous) animals and thrive on their sales.

Please sign this petition to help us stop this list from passing. This list MUST be amended and changed to a more realistic standard. Thank you.

While the intent to decrease instances of injury and death as well as the environmental cost of escaped, invasive species is something that should most assuredly be looked into, the proposed list of "dangerous and wild animals" has some glaring oversights as to what could be constituted as "dangerous."
