I need to stay on in school for one more year is because I need the schools support for my 2nd exam for next year 

Section 10 of Education Act places the Welsh Ministers under a general duty to promote the education of the people of Wales.

The primary focus is on those aged 16 to 18 but anyone over compulsory school age may participate in further education.

There is some blurring of the lines between further and higher education as further education institutions may provide higher education and higher education institutions may provide further education.

Funding for post-16 education is provided directly by the Welsh Ministers to institutions and this funding may be subject to terms and conditions determined by the Welsh Ministers.

 

The last year has seen an unprecedented change in schools and education that no legislation, including the Education Act could foresee or make provision for. Under normal circumstances I would have sat GCSE English and Maths at Crownbridge school, but with educational input from the neighbouring secondary school. Obviously, due to lockdown this did not happen. Now because I attended a special educational needs school I feel I am being discriminated against on grounds of my disability. Every other young person attending mainstream for GCSE examination is receiving a grade based upon teacher assessment because the arrangement, because of my need was that I would receive tuition and support whilst attending Crownbridge this did not happen and therefore I have been disadvantaged by this.

What I need to support my educational progression is to attend an additional year at Crownbridge to replicate the year of my education and support that I did not receive, where there was provision for mainstream pupils not to be educationally disadvantaged there was none for me.

From looking at the legislation with some help this seems to be within the gift of the Assembly with the consent of the school and Local Authority. I feel the following facts are relevant and there is no mention of an upper limit.

I strongly feel that the decision you make should consider two facts, the exceptional circumstances of last year and whilst there has been provision to ensure mainstream education were not disadvantaged with their CGSE’s there has been no such provision for me, so I have been treated unequally because of my learning disability.
