State v. Christy Rose Tuchel

Christy Rose Tuchel appeals a judgment of conviction entered on jury verdicts finding her guilty of causing mental harm to a child contrary to WIS. STAT. § 948.04 (2019-20), mistreatment of animals causing death as a party to a crime contrary to WIS. STAT. § 951.02, and twenty-four counts of failing to provide sufficient food or water for animals in her care as a party to a crime contrary to WIS. STAT. § 951.13. She also appeals an order denying her postconviction motion. She raises a plethora of challenges to her convictions, asserting: (1) the presiding judge should have been statutorily disqualified; (2) law enforcement violated her due process rights by destroying apparently exculpatory evidence; (3) her prosecutions under § 951.13 were unconstitutional; (4) a forensic interview of a minor was improperly admitted at trial; (5) various instances of ineffective assistance of trial counsel; and (6) she is entitled to a new trial in the interest of justice. We reject her arguments. Affirmed.
