The family could not afford an attorney, and they relied on the public defense system, one that gravely let them down. Seemingly the justice system has come down to how much one can pay for justice considering similar accidents for others in the area resulted in months vs years of prison time.
We are not here to expunge Aaron McGarva from his admitted guilt, but are here to petition the Governor of North Carolina to grant Aaron an appeal for a fair trial. One where hopefully a new lawyer, is able to present ALL the details of the case in order to properly defend Aaron so that a sentence commensurate with the facts of the case results.
When I first watched a youtube video of a car crossing the same bridge, my first thought was that perhaps Aaron fell asleep at the wheel: Watch it here: https://www.youtube.com/watch?v=L6fq2wwnhAA
Those that know this young man know he DID NOT ACT WITH MALICE, and that 11-14 years for this crime is oversentencing. It is our understanding, that one of the basic tenets and fundamental rights of the North American system of justice is that everyone is entitled to a full and fair hearing of the facts when presented before a judge and jury. This effort is in pursuit of that goal.
