Petition to
Penobscot County Unorganized Territory Adminastratiom Penobscot county commissioners

Why this petition matters

We ask people to show their support towards the operation of our small business, Up In Smoke Auto Recycling. In regard to our Recycler's License being suspended, made effective October 13th, 2021. We had our recycling license wrongfully suspended due to the Unorganized Territory Administration and the Penobscot County Commissioners. Following their actions of terminating our Title 30A permit without proper steps taken. It was stated on September 21st we had 90 days to comply with regulations or actions would be made to terminate our permit. As well as on October 5th we received a letter stating we had until November 5th to create a "Correction Plan" to meet the requirements (requirements that were never validated to be broke) Yet, it was only 3 weeks from September 21st to October 13th when we were contacted by Bureau of Motor Vehicles to inform us our license was suspended. Since then, we have been unable to conduct business to financially cover all the business costs. The Unorganized Territory Administration's major concern in rescinding our license was that the zoning of the property was not correct (according to LUPC's rules for the operation.) All these actions against us were taken due to 3 members of the community appealing this information on September 21st. Although it was the Unorganized Territory Administration and Commissioners who stated/informed us the property WAS ZONED CORRECTLY in the first place back in March, allowing us to apply and receive our Recyclers License in April of 2021.

This business is our life, we have invested everything into this business to be shut down for not being proven guilty of doing anything wrong. Not to mention we started this business in the middle of a pandemic and have suffered significantly after having our license taken so soon behind our backs. All this time, all we have asked is for the county to allow us to get our license back so we could financially meet any requirements that may have been an issue. We have been cooperative with all departments throughout this process, we just want to make a living. The County has ignored all our efforts to meet with them, until recently scheduling us a hearing. This hearing has been scheduled for December 14th at 9 am in Bangor, it is open to the public! Please reach out for more information regarding our meeting, all support is very appreciated!  We are asking people to sign this standing in support of our small business as we fight to have our license reinstated as well as recognize the unlawful actions that were taken against our business.
