My own firm opinion is that it should be illegal to question a kid this age without an attorney present. The stakes are far too high. Kids don't know their legal rights. Here is an immense study that says that kids shouldn't be tried as adults as doing so greatly increases the reoffense rate, also the attempted suicide rate rises by 3600%. I could see juvenile reckless manslaughter as his brain development is too immature to rationalize and pre-plan in an adult manner. He reacted badly to his brother not wanting to play holding a gun that his parents left loaded and unlocked. His parents are guilty. This kid is too young to have pre-planned this shooting in an adult manner.

This is a child and he was clearly the victim of neglect. He needs help and rehabilitation not only punishment and more loss of childhood. The system already failed him miserably, I cant stand to see it fail him again. There is no justice in this!

Yes he is wrong for what he did and he should be punished but as a child, not an adult. His brain is not fully developed, nor will it be until he’s MUCH older. He needs help and guidance along with his punishment, he won’t get this in an adult prison. One is gone, we don’t want to lose him too. Very sad situation all around.

When our children act out violently the responsibility falls on us, the society that has failed to guide them in recognizing the worth in their being. That is why we hold children to different standards. We must continue to defend the rights of children to learn and find redemption for their mistakes no matter how severe. This can only happen with care and compassion. No child should under any circumstances be tried as an adult let alone be subjected to the horrendous treatment that is commonplace in our adult prisons and jails.

Juvenile court is there to provide just consequences for juvenile actions. Biologically speaking, a 13 year old has not undergone the changes and brain development of puberty and therefore should not be tried as an adult.

His crime was horrific, however no child should be in adult facilities, he needs specific care and education.
