I, Alton Waddell, pursuant to VA Const. Art 5 Section 12 Executive Clemency, will provide an explanation of why Governor Ralph Northam should grant this Conditional Pardon in ending the 6 month conviction of 18.2-57(C) assault and battery on a law enforcement officer, and modify the 10 year conviction of 18.2-248 possession with intent to distribute heroin. Waddell was sentenced to a consecutive sentence of 18 years and 6 months. The 8 years for probation violation is not being contested. Since August 1, 2007, Waddell has served over 12 years and 6 months.

The extraordinary circumstances in ending the 6 month conviction of 18.2-57 (C) is that the testimony of detective Johnakin, within the suppression and trial transcripts, collectively as a whole, strongly shows that Waddell did not commit an assault and battery against the officer. Waddell only reached to protect himself of the officer's aggressive actions.In modifying the conviction of 18.2-248 possession with intent to distribute heroin, newly discovered evidence of Waddell's jail medical records, publications by the World Health Organization (WHO) "Neuroscience of Psychoactive Substance Use and Dependence: Summary," and Waddell's statements in the presentence report provide reasons for the conviction to be modified to the lesser included offense of possession. Waddell's medical record reveals his history of chronic heroin abuse. (WHO) research provides  studies on brain dysfunction due to psychoactive substance use and how an individual is classified as being dependent on drugs. Waddell's statements in the presentence report shoes his addiction was based on and he had obtained the drugs. All of the evidence that was mentioned was not presented, nor fully considered at trail or sentencing.
