SARS CoV-2 Vaccine must be by choice. Government coercion must stop. Abuse by public officials of their ability to make Public Health Orders must stop. Internal borders must re-open and people must be allowed to lawfully exercise democratic freedoms and live their lives in peace.

We, the undersigned, hereby petition that the State, Territory and Federal Governments of Australia must recognise peoples' right to bodily integrity when considered in the context of accepting any vaccine against SARS-CoV2 or its resultant disease. Whilst the available vaccines have differing levels of approval in different jurisdictions, it is a simple and verifiable fact that long term safety and efficacy data does not exist in relation to these preparations. It cannot yet exist, quite simply because the preparations have not been in existence that long. Stating that vaccines are voluntary, whilst increasing levels of exclusion experienced by unvaccinated persons to the extent where it affects their livelihood and ability to participate as a functional member of society in a non-discriminatory way, amounts to coercion and DOES NOT equate to the vaccines being voluntary. People have the right to choice, and it stands to reason that once long-term safety is scientifically established, even many of those currently exhibiting vaccine hesitancy will be willing to accept these vaccinations.

Current vaccination targets appear to be on track in all Australian jurisdictions. While some state populations have lower vaccination rates, as at 2nd October 2021 79.36% of Australia's population aged 16 and over had received the first dose of a vaccination against the Coronavirus Disease. This includes 93% of ACT residents, 88% of NSW residents, 82% of Victorian residents and 77% of Tasmanians. There appears to be no need for any further tightening or coercion by state governments, and ESPECIALLY the type of coercion and discriminatory policy currently being implemented by the Victorian and NSW governments. Whilst in many cases it has occured under duress, MOST eligible Australians have allowed themselves to be inoculated voluntarily and there is NO place and NO justification for the governmental coercion that citizens of Victoria and NSW are currently experiencing.

Deputy President Lyndall Dean of Australia's Fair Work Commission states in relation to mandatory Covid-19 vaccination (in disagreement with a majority vote handed down in FWC Decision [2021] FWCFB 6015):

"Mandatory COVID vaccinations, however, cannot be justified in almost every workplace in Australia."

"All COVID vaccines in Australia are only provisionally approved, and as such remain part of a clinical trial."

"Coercion is not consent. Coercion is the practice of persuading someone to do something using force or threats. Some have suggested that there is no coercion in threatening a person with dismissal and withdrawing their ability to participate in society if that person does not have the COVID vaccine. However, nothing could be further from the truth."

"Informed and freely given consent is at the heart of the [Nuremburg] Code and is rightly viewed as a protection of a person's human rights."

 “Freely given consent to any medical treatment, particularly in the context of a clinical trial, is not optional. Coercion is completely incompatible with consent, and denying a person the ability to work and participate in society if the person does not have a COVID vaccine will unquestionably breach this fundamental and internationally recognised human right.”

“Vaccines have not been broadly mandated on health and safety grounds in most countries.”

In relation to Public Health Orders and long-term lockdowns, Ms. Dean states:

“In making blanket rules in PHOs which deny people their fundamental right to work or operate to “lock them out of society”, and which denies them freedoms which are a fundamental and essential part of any democracy, concepts of reasonableness, necessity and proportionality arise. In other words, decisions taken to restrict or remove basic liberties must be proportionate and necessary to manage the risk and must be the minimum necessary to achieve the public health aims.”

“Blanket rules, such as mandating vaccinations for everyone across a whole profession or industry regardless of the actual risk, fail the tests of proportionality, necessity and reasonableness. It is more than the absolute minimum necessary to combat the crisis and cannot be justified on health grounds. It is a lazy and fundamentally flawed approach to risk management and should be soundly rejected by courts when challenged.

“It should be abundantly clear that there are other, far less restrictive and less intrusive ways in which we can ensure public health and appropriately address the risk of COVID without resorting to the extreme measures currently in place.”

“The current PHOs have moved well past the minimum necessary to achieve public health aims, and into the realm of depravation. It is not proportionate, reasonable or necessary to “lock out” those who are unvaccinated and remove their ability to work or otherwise contribute to society.”

“[PHOs] are not intended to be an ongoing vehicle to enforce significant depravations of our civil liberties. …The time is fast approaching where the reliance on PHO’s will no longer be justified on public health grounds, particularly where there is such a significant intrusion on individual liberties.”

Ms. Dean is a highly educated and eminent former workplace relations lawyer and her appointment to the FWC in 2016 had the endorsement of Senator the Hon Michaelia Cash. In her final comments in the above FWC decision, Ms. Dean rightly states that “All Australians should vigorously oppose the introduction of a system of medical apartheid and segregation in Australia. It is an abhorrent concept and is morally and ethically wrong, and the antithesis of our democratic way of life and everything we value.”

By adding your name to this petition, you recognise that there are broader implications for our freedoms, democracy and human rights leading on from the impositions that our elected representatives and their so-called “advisers” have implemented by way of numerous restrictions, lockdowns and Public Health Orders. You do not subscribe to the notion of being “anti-vaccine”, however you subscribe to supporting and restoring the democratic rights of Australians. You oppose the introduction of a system of medical apartheid and segregation in Australia. This includes so-called “vaccine passports”. Mandating vaccination in all but the absolutely highest-risk professional groups (such as Residential Aged Care and certain health care providers/facilities where there are genuinely vulnerable people at risk) amounts to an abuse and over-reach of governmental powers and must immediately stop. The toll that the increasingly despotic and disrespectful actions of state premiers such as Daniel Andrews is taking on peoples’ mental health now outweighs any benefit of further and ongoing restrictions in relation to the coronavirus pandemic. Ongoing Public Health Orders and increasing levels of tyranny are not the peoples’ will, and all governments in Australia must now move towards reducing restrictions on citizens’ liberties, with a view towards returning to a normal life. Interstate borders must also re-open in line with constitutional provisions. Mandatory vaccination orders in all Australian jurisdictions should be repealed for all professions other than those dealing directly with large numbers of the most vulnerable persons. Mandatory vaccination orders are for the most part unlawful, undemocratic and unacceptable. Most people in Australia are accepting of vaccination as a suitable method of disease prevention and control, and Australia’s SARS-CoV2 targets are well on track to be achieved without any such mandates. Whatever your stance on this particular vaccine, there is a very big difference between upholding democratic rights and freedoms, and “mandatory vaccination by stealth”. Those who wish to be vaccinated and have done so presumably face little to no risk from those who remain unvaccinated. Some people cannot safely accept this vaccine. Some people do not wish to. We as humans have a right to bodily integrity and governments must not interfere with this fundamental human right. Nobody can force another person to do something, or not do something, to their own body. This respect is a fundamental principle of liberal democracy and morality in contemporary civilised society.
