Remove Donald Trump From The Presidency Under The 25th Amendment

With the abrupt and illegal firing of the Acting Attorney General and the Director of Immigration, Customs and Enforcement (ICE), the unconstitutional, immoral, and un-American ban on Muslims entering America, and the improper elevation of Trump senior advisor Stephen Bannon to a permanent seat on the National Security Council, Donald Trump has convincingly demonstrated his unfitness for office, and satisfied the base requirements to be removed from office under the 25th Amendment.

The firing of Sally Yates, the Obama appointee who had been asked to serve as the Acting Attorney General of the United States until Monday night, was both improper, as her behavior was neither improper nor unconstitutional, and unwise, as it left the Justice Department temporarily leaderless until U.S. Attorney Dana Boente was tapped to serve in her place. Yates principled objections to the Trump Administration’s ban on Muslims traveling to the United States was entirely in keeping with her position as the Attorney General. Her oath was to the Constitution, not to Donald Trump or Stephen Bannon. The executive order instituting the ban was unconstitutional and indefensible. Her position of not defending the ban was principled, proper, and in keeping with the law and American traditions and ideals. She should not have been fired.

Similarly, the firing of Acting ICE Director Daniel Ragsdale was similarly abrupt, inexplicable, and political in nature. The Administration gave no explanation or reason why Ragsdale was dismissed; he was just dismissed, without reason or cause.

As to Stephen Bannon, his placement on the National Security Council in a permanent seat is both unprecedented and a threat to national security. His radical, un-American views are behind many of the Trump administration's policies and actions that have detrimentally affected millions of Americans. Bannon is now elevated above both the Chairman of the Joint Chiefs of Staff and the Director of National Intelligence, although he has no experience in national security policy or government, and is an avowed white nationalist. This lack of experience and embrace of a racist and divisive ideology, however, was not seen as disqualifying. He joins disgraced conspiracy theorist Lt. Gen. Michael Flynn, the National Security Advisor with questionable ties to Russia, as a permanent member of the NSC. These are not men who can be expected to act in defense of the security and general welfare of all Americans; indeed, their very loyalty to the nation is questionable.

The Trump administration has, in nine days, frightened, confused, and upturned the nation and the entire world. This administration began with a policy of lying about even the most minor, irrelevant issues, moved on to begin a negative, frightening upheaval of our relationships with allies and alliances, irrationally threatened our adversaries, and instituted a policy of suppressing science that disagrees with their ideological viewpoints. The recent radical and unconstitutional changes to American immigration policy is just the latest in a series of unlawful, racially tinged departures from established law and tradition, which started with Trump's much-ballyhooed border wall and continues with a useless investigation into three million non-existent illegal voters.

These changes are not merely the result of ideological differences between conservatives and progressives, between Republicans and Democrats. These differences are the result of an irrational, un-American ideology promulgated by a racist, kleptocratic worldview, and put into place by an ignorant and unhinged mind. No sane national leader would threaten allies and adversaries alike. No sane politician would issue contradictory orders every other day. No psychologically healthy individual would focus on the size of his adoring crowds instead of attending to the duties of the office of the President. These latest acts, along with the torrent of nonsensical, illegal, and contradictory executive orders from the new president, demonstrate his unsound mind and unfitness for office.

From the night of his election, through the transition period before his inauguration, to the first moments of his presidency and to today, Donald Trump has demonstrated that he is intellectually, emotionally, and psychologically unfit to serve as the President of the United States of America. His demonstrated incompetence is not merely the product of ignorance and inexperience, but the product of a diseased mind. He has shown repeatedly that he lacks even the basic stability required of any political office holder, much less the President.

The 25th Amendment allows for the removal of the President from office. Section 4 reads as follows:

“Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.”

We, the undersigned, ask and petition Vice President Michael Pence, and the serving members of the Cabinet, to obey their oaths to the Constitution and their duty to the nation, and proceed under the 25th Amendment to immediately remove Donald J. Trump from the office of President of the United States of America. Our nation and the world can longer tolerate the risk of keeping this mentally ill man in office another day. History will honor you. Do your duty, and remove Donald Trump from office.
