US District Attorneys: Prosecute Bill Clinton for War Crimes

Former President William Jefferson (Bill) Clinton should be arrested for violating Articles 23, 25, and 27 of the Hague Conventions IV of 1907, which are codified under the War Crimes Act of 1996 (18 U.S. Code § 2441, by bombing the al-Shifa Pharmaceutical Factory in Sudan on August 20, 1998. Under section (c)(2) of the War Crimes Act, any conduct considered “prohibited by Article 23, 25, 27, or 28 of the Annex to the Hague Convention IV, Respecting the Laws and Customs of War on Land, signed 18 October 1907” is considered a war crime. These war crimes are punishable at the discretion of the court by imprisonment for “life or any term of years, or both, and if death results to the victim, shall also be subject to the penalty of death,” as written under section (a).
Specifically, there is substantial evidence to establish probable cause and the basis for criminal prosecution against Mr. Clinton for the following:
1. Violating Art. 23 of Hague IV (“it is especially forbidden… To employ arms, projectiles, or material calculated to cause unnecessary suffering”) by employing arms against the al-Shifa Pharmaceutical Factory in Sudan, a calculated effort to deprive the Sudanese people of medicine that would prevent medical suffering and death.
2. Violating Art. 23 of Hague IV (“it is especially forbidden… To destroy or seize the enemy’s property, unless such destruction or seizure be imperatively demanded by the necessities of war”) by destroying al-Shifa, a medical facility and piece of property that had absolutely no association to any military endeavor and was in no way necessary to harm in any way.
3. Violating Art. 25 of Hague IV (“The attack or bombardment, by whatever means, of… buildings which are undefended is prohibited”) by attacking a medical facility with no means whatsoever of defending itself against overwhelming force.
4. Violating Art. 27 of Hague IV (“In… bombardments all necessary steps must be taken to spare, as far as possible, buildings dedicated to… science… [and] hospitals… provided they are not being used at the time for military purposes) by razing a facility dedicated to science and the production of medicine that the Sudanese government had taken all possible measures to demonstrate was not being for any military purpose whatsoever.
The evidence for these charges against Mr. Clinton is overwhelming and in the public record. It has been covered by journalists, human rights organizations, and politicians for years. More evidence will likely be able to be found in discovery. Furthermore, there is also substantial evidence that Mr. Clinton violated Hague IV and common Article 3 of the Geneva Conventions through his actions in Iraq, Somalia, and the former Yugoslavia, as well as in his worldwide rendition program.
In summary, Mr. Clinton should be arrested for violations of subsection (c) of the War Crimes Act of 1996 for numerous violations of Hague IV in Sudan and most likely other countries as well.
