When is come to evictions a tenant should not have the right to file bankruptcy in order to have a Motion to Stay as this affects the home owner causing a hardship and the possibility of home being foreclosed on and the negative impact on their credit that can also affect them personally and on a business level. There are to many home owners that have lost there homes because the law is not in their favor. If tenants can not afford to pay they can not stay.
If a tenant has a hardship this should not be passed onto the home owner. Nor should tenants be given the option to appeal since many do not pay their judgement into the Court Registry nor do the courts enforce the law as long at they are getting paid their court fees.
This is only regarding people that can not afford to pay their rent.
