My name is Rushaun Parker Federal number 52806-056 Case number 7:10-cr-00011-H-1 I was originally sentenced to 420 months in prison 360 month for drug charges 60 months for possession of firearm infurtherance of a drug trafficking crime my lawyer kept telling me to plea and cooperate I told my lawyer I didn't have any information on anyone I asked for a new attorney I asked my new attorney could he get me a plea for 15 years to life he said no because I had already been enhanced I then ask him what was the plea he told me 25 years to life 20 for the drug charges 5 years for the gun charge I told my lawyer that I was willing to plea to the 25 years he told me that I will get life because they have My confession and it's best that I went to trial I never said that I sold 5 kilograms at age 15 nor did I write any of statements the agent wrote everything down I was told to initial I never
read what they wrote. I went to trial my indictment is only 50 or more grams. The drug amount attributed to me is only 87.4 but at my final sentencing I will charge with 5 kg of crack. In May 2012 I was resentenced to me not being a career offender also my 851 enhancement was removed and my 922(g) conviction was removed however I still remain sentenced to 5 kg I understand at the time of my sentencing was necessary but laws change and their continuing to do so and I have not gotten the proper relief that I'm entitled to under current law. When I got 851 enhance they took my minimum from 10 years to 20 years when I got it removed they only took a total of 3 years off. My statue of conviction is 50 or more grams 841 b1 a1 at the time of my sentencing it provided a mandatory minimum of 10 years the FSA amended 21 USC 841 b1a1 by replacing 50 g with 280 G. My statue of conviction now
provides a mandatory minimum for 5 years 50 or more grams is now 28 to 279 G of cocaine Base still I remain sentenced to 5 kg of crack cocaine base the law states that it's your statue of conviction that determines your eligibility not your actual conduct even though my actual conduct is only 87.4 G but I'm still sentence to 5 kg of crack. If I get sentenced right now today I will have nowhere near the sentence I have. the rules and laws were being bent in my case, and when it is bent in one person's case, then it will be bent in any person's case, including a white person, and that this is exactly why we cannot have criminals running our courts. I have been arguing my case sighting law and I'm still getting the cold shoulder I have been in the B.O.P. custody since I was 20 years of age I'm 31 years old now I have been back to court on a 2255 for an evidentiary hearing and still got denied even though everything was in my favor due to the record. I need someone to look into my case and help me out the Dynamics have changed so much in my case if I was sentenced today with a regular plea me not being forced going to trial I would be home. I was only a kid I didn't know anything about an open plea or as much as I know about the law now and I still don't know everything I have gottenmy GED a few certifications and I have not been in any trouble.
