  • Asking the United States Sentencing Commission; to make the new 3-strike sentencing reform law retroactive for 3-strike non-violent drug offenders enhanced under the 851 enhancement.

     The Criminal Justice Reform Act S. 756 was passed into law by the United States Senate and the United States House of Representatives. The U.S. Senate passed the Bill on December 18, 2018 and the U.S. House of Representatives passed the Bill on December 20, 2018. The President of the United States Donald J. Trump signed the Bill into law on December 21, 2018. Title VI of the First Step Act Bill, section 401, the 3-strike mandatory life sentence for non violent offenders of drugs was changed to 25 years down from a mandatory life, but this change of law and statute was not made retroactive to prisoners already in federal prison serving mandatory 3-strike life sentences. The reason the law and statute was changed is because some Senators and some House of Representatives investigated the 3-strike law and saw that it was the most harshest, unfair federal law and sentence that existed for 851 enhanced non violent drug offenders.

     Since mid-2014, FAMM, Fed-Cure and other legal non-profit organizations had been telling the federal prisoners, to have their families contact their Senators and Congressmen and ask them to support the Sentencing Reform Bill. The prisoners serving these non violent mandatory 3-strike life sentences did that and more. The prisoners reached out to their families and friends and asked them to contact our Senators and Congressmen and they most definitely did that. So now when the Criminal Justice Reform Act S; 756 was passed, it excluded the federal prisoners already serving non-violent 3 strike mandatory life sentences. The only one who benefit from this non-retroactive change of statute and law is the future federal prisoners who haven’t even come into the federal system yet. The prisoners already serving these sentences are the reason why the Bill was changed and they did all the work that they and their families could do, but weren’t included to get any relief from the change of the 3 strike law. 

     All of the 3 strike non- violent drug offenders serving mandatory life feel that they’re being left out and not being able to get relief from this change is wrong. So the mandatory 3 strike non-violent drug offenders serving life sentences are now asking the United States Sentencing Commission, to take up this change of federal law and look at making it retroactive. It’s a little over 1,500 federal non-violent drug offenders serving the 3 strike mandatory life sentence. Many have served decades and do deserve to get the relief, from the changing of the 3 strike mandatory life federal sentencing law. So we pray that this honorable United States Sentencing Commission looks into making this 3-strike mandatory life sentence, changed to 25 years, retroactive to the federal prisoners already serving these harsh, cruel and unfair 3 strike mandatory life sentences. Now we ask our families, friends, associates and people who care, to sign this petition in support of the United States Sentencing Commission making this new sentencing 3 strike law for non-violent drug offenders, serving  mandatory life sentences retroactive.
