My name is Lena and, like you, my stimulus check was intercepted (offset) by the US Treasury department. If you or your spouse is behind in child support, you may receive a reduced check or won't receive one at all. Hundreds were expecting to receive a stimulus check to help pay for supplies, bills, food and rent.

According to the CARES act certain debts are suspended from garnishments. Overdue student loans and back taxes are exempt from being offset. Many married couples are learning that even late payments are being reduced or withheld as well. Which means spouses filing jointly are putting their stimulus checks at risk! Also, claiming unemployment benefits with a child support order in place can have your payments withheld.

The stimulus relief was designed to give Americans a financial boost during the Covid-19 pandemic crisis. In 2008 the IRS allowed those who filed injured spouse to receive monies during the financial crisis. Why should this be any different? With businesses and schools closed throughout the country to slow the spread of the virus, many have lost their jobs and are being threatened with evictions. Along with city/county curfews and stay-at-home orders, anxiety and uncertainty run high. Withholding our relief checks isn't fair! 

Salaries are lost because of social distancing and having our promised money offset during a pandemic is a callus decision!  Roughly, the IRS claims it hasn't issued guidance in this matter surrounding injured spouse relief and they're still awaiting direction from the OCSE. Again, what makes this situation any different? I'm sure the same child support owed during the financial crisis of 2008 is owed today! This is just another poor excuse to collect on debts. 

If Congress decides to support families with a $2000.00 monthly payment, those owing child support will be left out yet again! Thousands are struggling to make ends meet and are financially stressed because they either received a reduced payment or nothing at all. Imagine not having the financial assistance to provide basic necessities and essentials because our government and leadership refuse to make changes.

I'm asking all those responsible to revise this decision...remove the offsets and allow payments to be returned to those impacted. Now is not the time to collect. Funds should not be withheld from anyone during any global or statewide pandemic or emergencies.
