The Biden Justice Department is continuing to shield Donald Trump from responsibility for his words and actions. The DOJ, under Merrick Garland, is seeking to represent Trump against a lawsuit brought by a woman who alleges Trump raped her in a department store in the 1990's. Trump denied the assault allegations made by columnist E. Jean Carroll in 2019, saying he had never met her, despite photographs showing them together at social functions. He questioned her credibility and further insulted her by saying, “she's not my type.”

Carroll brought a lawsuit claiming that Trump had damaged her reputation and livelihood when he made these statements.

The DOJ, under William Barr, and now Garland, is arguing that Trump was acting within the scope of his duties as president in publicly denying these allegations. They are asking the court to be allowed to “stand in” for the former president, effectively denying Carroll's right to confront Trump directly.

I started this petition as someone who has followed this case closely from the beginning. In fact, I was inspired to create the above slogan during the campaign to show my disgust with a person who demonstrated time and again he was unfit to hold the office of president. I take the Justice Department's position as a personal affront to me as a woman; as a survivor of sexual assault; and as an American citizen. To insert the “United States” in place of Trump into this suit is not acceptable. The male attorneys making the case for the DOJ are using spurious arguments and cherry-picking “acts” (FTCA, Westfall) that ultimately reinforce the position that a president is above the law. The DOJ has shielded Trump for years – not based on established precedent and law, but on a “memo” saying presidents can't be indicted while in office. Well, he's not in office now. I believe he has committed many crimes, both before and during his time as president. It is time to stop this insane disconnect that sets Trump apart from every other person in this country and hold him accountable.

As Carroll's lead attorney Roberta Kaplan stated, “the DOJ's position is not only legally wrong, it is morally wrong since it would give federal officials free license to cover up private sexual misconduct by publicly brutalizing any woman who has the courage to come forward.”
