This petition seeks justice for Mr Kulbhushan Jadhav an Indian citizen and ex-naval officer aged about 46 years who was abducted from Iran and taken to Pakistan.
The said Mr Kulbhushan Jadhav is awarded death sentence over charges of terrorism and spying for India's Research and Analysis Wing, which is totally false and baseless.
The fact that India isn't given consular access to Kulbhushan Jadhav clearly proves the point that the charges over which death sentence is awarded to Kulbhushan Jadhav are false and fabricated and were framed with an intention to damage India's reputation in the International community.
Being a party to "The Vienna Convention on Consular Relations, 1963; Pakistan was not only obligated to provide arrangement for Kulbhushan Jadhav's consular access but was also supposed to inform Indian consulates about any such detention of an Indian national, failing both Pakistan has not only violated Kulbhushan Jadhav's right to legal aid but also International norms.
Kulbhushan Jadhav's execution, without providing him proper legal aid, which is possible only by giving India the consular access to him, will not only violate his right to legal remedy but will also violate his basic right to life and leave India defamed in a best possible way.
In view of above, I humbly request appropriate and capable authorities to intervene in the matter and make sure that Mr Kulbhushan Jadhav doesn't get punished for the act which he never committed. I also request International Court of Justice to take Suo-motto against Pakistan on breach of article 36(1)(c) of "The Vienna Convention on Consular Relations, 1963. I also urge other UN members to pressurise Pakistan government and help India get consular access to Kulbhushan Jadhav.
