Jammu Kashmir Demands for Referendum

The people of Jammu Kashmir suffer from being given a fate, a life which has been a result of barbaric and ruthless actions of precedent individuals and governments. 

In light of Shimla agreement 1972 a negotiated solution is to be found where both sides agree to, adding to which the Charter of the United Nations would be implemented in the case of Kashmir till a solution is found. 

This petition is to highlight and demand the reinforcement of the agreed pact of 1948 of the United nations Security Council that Kashmir's have the right to self determination  by a plebiscite and decide if they wish to be a part of India or Pakistan.

Nonetheless, if we account on the Universal Declaration of Human Rights, we can identify repeat violations of Human Rights in Kashmir and this in it self seeks action for the best interest of the people and to prevent further physical,emotional or psychological trauma. As the declarations states it is a common standard of
achievement for all peoples and all nations, and hence this does not eliminate the people of Kashmir to be excluded from such a declaration.

Looking in depth of the Declaration any individual can see and identify violations of:

Article 2: Everyone is entitled to all the rights and freedoms set forth in this Declaration... Furthermore, no distinction shall be made on the basis of the political,
jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty. 

Article 3 : Everyone has the right to life, liberty and security of person. 

Article 5: No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.

Till date the death toll of known killings and violence has increased tremendously since 2010. With over 8,932 civilians injured in 2016 against 1,047 in 2010.

The individual case files we documented by the Doctors Association Kashmir is enough to evoke a cry for some action from the international silent media and Human Rights Organisation's.

Just two examples are given below from the 30-40,000 reported incidents in Jammu Kashmir till 2016 recorded statistics as followed:

- 30-year-old contractual lecturer beaten to death in Khrew. The deceased was identified as Shabir Ahmad Mongu, son of Wali Mohammad Mongu, resident of Sharshali Khrew.

- Bilal Ahmad a 9 year old boy from kupwara hit by pellets in his right eye.

Article 15
1. Everyone has the right to a nationality.
2. No one shall be arbitrarily deprived of his nationality nor denied the right to
change his nationality.
