Approve Jason's marriage to Gayano's as "Genuine and Subsisting" and NOT a Marriage of Convenience

Jason and Gayano met in Auroville, India in December 2009 but lived worlds apart - Jason in India and Gayano in Wales. When Jason asked Gayano to marry him in July 2012 neither had any idea of the challenges they would face attempting to do what most people take for granted - getting married and settling done to live with their new spouses in the same house, in the same city, in the same country. In that same month the UK Border Agency began enforcing new restrictions to immigration rules for British citizen's attempting to marry non-EU citizens and settling in the UK. These new restrictions meant that any British citizen earning less than £18,600/yr was prohibited from marrying a non-EU citizen in the UK and was prohibited from bringing their existing spouses into the UK to live.

Luckily for Jason and Gayano they learned of the existence of Directive 2004/58/EC of the European Union that governs freedom of mobility for all EU citizens and the European Court of Justice case of Surinder Singh. This established a legally binding route for all European citizens to bring their immediate family members (including spouses) back to their home countries by first working in another European state for a period of time exceeding 3 months.

In order for Jason to return to the UK with Gayano and live their with his family the UKBA needs to agree that his marriage to Gayano is genuine and that their relationship is ongoing ('subsisting' in legal language) as opposed to a marriage of convenience which they define this as: "... a sham marriage entered into solely for immigration  purposes."

Since we know that you know that our union is Sincere and Genuine we've created this petition to our friends and family asking you to declare that you know our union to be "subsisting and genuine" and NOT a marriage of convenience. If you could also indicate how you know us and for how long and please feel free to include any other relevant information about why you think we should be allowed to live together in the UK.

We are requesting that only people that know us directly (whether you've met us in person or via the internet) sign the petition.

We will gather all the signatures and comments and include them with Jason's application for a Family Permit that we intend to file with UKBA at the end of April.
