Normally when you appeal a decision and win, the decision you appealed is overturned.

example if you have a claim for a benefit refused on 1/1/20 and you appeal and the appeal date is 1/1/21 and you win then you get back paid to the 1/1/20.

UK Visas and Immigration do not follow that, instead rather than backdate the issue of a visa to the day of the refusal they start it from the day of the overturn decision.

in many case this means that due to the backlog in court cases, visa applicants awaiting an appeal hearing can be waiting more than 1 year, then when the get their viss issued it means they have been in tbe country without a valid visa for over a year even though the refusal was overturned.

This takes the applicant off the five year route and puts them onto the 10 year route from scratch which puts them back to zero with 10 years left before they are eligible for Indefinite leave to remain instead of only having a year and a half left to go.

This is immoral and is punishing applicants and costing them more than £10,000 in costs over 10 years and meaning rather than taking 5 years to get their Indefinite Leave to Remain, applicants are forced to take 13.5 years. 

There can be no justification for this especially when the UKVI change the rules midway during someones application and halves the time applicants have to get paperwork in resulting in a refusal under the new rules as they certainly dont notify applicants on rule changes and even court judges are unaware of these changes.

It is unfair, unjust and highly immoral and needs to be addressed and stop innocent people being penalised due to the UKVI abusing its power.

Due to the stresses involved in this my wife suffered a miscarriage during the appeal hearing and spent 4 days in hospital and still suffers with mental health due to the loss of our child. 

i am more than willing to discuss this with the press where i can present numerous evidence including official court papers.
