Power of Attorney Abuse - LPA, things you may not know, protect your loved ones!
The appointment of Legal Power of Attorney
The current legislation states that all relatives “SHOULD BE INFORMED”, so they can raise objections.
However as this states SHOULD, this has meant that we as a family were completely unaware of the change in a situation.
Firstly, that someone had applied to be Legal Power of Attorney.
Secondly, what their intentions were at the time and are at present and future.
Thirdly, how do they know the person they are applying to be LPA of.
As a result, when the LPA decided to announce herself and get involved in our relatives care, we had no say or influence in any decisions.
The LPA is an extremely powerful position, as our family have experienced to our cost.
Our relatives LPA has decided that she will control:
Who is aloud to visit our relative and when,
Where our relative is living and at what cost to our relatives estate,
What possessions and assets can be kept or must be sold,
What legal team get put in place (potentially people working in the LPAs interest)
The LPA dictates everything about our relatives life, including welfare and social
interactions.
We believe as a family, we have not been given the opportunity to raise concerns about the grant of LPA and the right to appose the person who has self appointed themselves to the position. The LPA may manipulate a vulnerable person to get a signature to take control with out anyone knowing.
This is despite our relative on several occasions expressing a view that the LPA is not working in her best interests.
The LPA has control on everything, including getting our relative deemed not to have capacity, resulting in our family being unable to change anything.
Our proposed change to the granting and application process of LPA, would be that reasonable efforts MUST be made to contact the family and Next of Kin of the person. As it stands no efforts were made to inform the family, in fact the opposite occurred, to ensure we were not informed and we could not contest the granting of LPA. There is no cooling off period our time frame to challenge this award.
