The new IR35 legislation seeks to make tax regime fairer in the way employees and contractors are taxed. What the legislation fails to address is the consideration that the contractors are not entitled to any benefits that the employee enjoy internally. If the intention of HMRC is fairness why then penalise the contractors by imposing same taxation as employees but without due consideration of the benefits? (e.g. Holidays, Sick Pay, Pension, etc.). We demand that the IR35 legislation makes adequate provision for coverage of the benefits enjoyed by the employed counterparts so as to make it fairer as was the original intent.
