For far too long non resident parents in full time employment in PAYE schemes have been unfairly treated by the Child Maintenance Service taking overtime and bonuses into account. Not allowing non resident parents to actually have a life of their own. Sometimes paying way over the average cost for keeping children. It doesn’t ask if the resident parent is paying the same as if they would do as a married unit. Just because someone earns some overtime does that mean the children need more food or clothes? Overtime etc is not a guaranteed income. This constitutes a breach of their human rights afforded to them under ECHR European Court of Human Rights

The solution is simple. Stop using overtime and bonuses for non resident parents who already pay. Use a standardised formula with benchmarks for set incomes.
Pursue those that actively seek not to pay at all. Give non resident parents the chance to have a life and a relationship with their children.

I started this petition because…
I am a non resident parent of two girls and since my marriage broke up have always tried to have a relationship with them. This has been marred along the way by the child maintenance service demanding more money using overtime and bonuses although not gauranteed to calculate my payments. This has had a negative impact on my relationship as I cannot just take them out for a snack/dinner or coffee as it’s not classed as me having them. As overtime etc is taken into account it leaves me very little to be able to spend on the children or myself.
