Kristen Kiser started this petition to U.S Supreme Court and

I think most of us are aware the U.S Criminal Justice System is severely flawed, at best. There are so many issues that need to be fixed/changed/righted. This particular issue relates to Prosecutors abusing their power by “Direct Indicting” U.S. Citizens that allegedly committed the crime(s) they are charging them with.

I’ve done extensive research on this due to a personal encounter I’ve had with them doing this to me personally. They charged me with “Possesion of a controlled substance”, 2 years after they originally pulled me over. I told the officer then & have since proven the fact that It was my valid prescription.
upon doing so, they “direct indicted me” (Came & arrested me out of nowhere) a few weeks before trial, wreaked havoc on my entire life, cost me my job, my credibility, my home I was in process of purchasing, etc, only to put me in a vulnerable position (incarcerated) as well as make me look worse to the judge by being incarcerated.

They have a 98% conviction rating & will maintain that at any cost. If you’re incarcerated, you’re more likely to take a plea vs fighting the charge, because at that point, you’re desperate to get out & fix your life they just destroyed.

It’s known that this is a prosecutorial abuse of power & is frowned on by all. However, the supreme court won’t do anything to stop it. They are not charging you with anything new, they take a charge they nolle prosequi (like dismissed, only they have the power to bring it back up at any point and re-charge you with it cause it suits them to do so).

In my case, they incarcerated me for 23 days, and once finally at court, the judge apologized and told me this was not supposed to happen, he put a “hold for service” on the indictment & thought I was already incarcerated (per the prosecutor). However, once arrested, they did nothing to correct their mistake & just left me in there over 3 weeks for no good reason at all & destroyed my job, career, credibility, caused the loss of a house I was purchasing, inflicted emotional distress on myself & my son. Although I’ve provided proof of my prescription & that I did not in fact “posses a controlled substance”, they still won’t let it go, they want me to plead guilty instead to a “failure to appear”, which they amended from a misdemeanor to a felony, after it has been heard, dismissed, dealt with in General district court over a year prior.

This is done very regularly, it’s a very common tactic used by Va prosecutors & it by no means is fair or just. Please help me to stop this abuse of power.
