We are calling upon you to propose a bill that would benefit freelance musicians across the country.

There are large numbers of military service bands across the United States. Many of the military band musicians, in addition to their full-time military commitments, are taking music performance jobs from civilian freelance musicians. They are “moonlighting” in paid symphony orchestras, musical theaters, wedding bands, churches, recording sessions, concert halls, and more. Many are also teaching in area colleges and universities.

Military band musicians already have the benefit of a competitive full-time salary, flexible work hours, tax-free housing/subsistence allowances, free lifetime medical, dental, and prescription insurance, commissary privileges, 30 days paid vacation each year, tuition assistance, retirement benefits, free musical instruments, and more. Meanwhile, freelance musicians, many with the same levels of training and expertise, are struggling to make ends meet.

To make matters worse, military band musicians are often hired simply for the prestige of having a musician who is in a military band.  Equally qualified civilian musicians are being excluded from numerous potential employment opportunities as a result.

The Department of Defense does have written policy designed to protect civilian musicians from this. However, it is ignored by the service bands and their musicians. DoDD Policy 5410.18 § 4.2.17.1 reads:

Competition with Commercial Musicians…Military musicians generally shall not compete with commercial musicians.

Further, § 4.2.4.2 reads:

Musical Resources…a military band or choral group, or portion thereof…is not generally available to support non-Federal entity events.

We have seen military bands hired over civilian bands because, for the purchaser, it's free entertainment to them.

To protect civilian musicians, we are asking you to propose a bill entitled The Civilian Musician’s Job Protection Act, which would make it federal offenses for military bands and musicians to take outside civilian music teaching and music performing jobs and for civilian contractors to hire military band musicians.
