I want to live in a world where police are held accountable for their actions, citizens have a say in their own policing, nonviolent offenders aren't targeted by the archaic "3 strikes and you're out" sentencing procedures, and every defendant gets a real chance at trial. My name is Logan Davidson and I want to bring Justice for George Floyd and the many other black lives that have been lost through police brutality or the cyclical incarceration system. POLICE ACCOUNTABILITY, CITIZEN REVIEW, AND JUDICIAL PROCESSING ACT
Section 1 (Accountability)
A. Torres v. Madrid will be overturned in that excessive use of force can be filed even in the
event that the force does not end in seizure. Excessive use of force shall be directed to the
district court, and all trials for excessive use of force shall be reviewed by a Jury.
B. Failing to record encounters via bodycam while on active duty can be filed to the district court
level under obstruction of justice and will be subject to prosecution for obstruction of justice
for no less than 1 year in jail up to 25 years in prison. Any encounters in which the bodycam
of an officer is rendered malfunctioning or unable to record an encounter, the officer must
retreat from the scene to a reasonable distance and request backup so that all encounters
are fully recorded and subject to review.
C. Law enforcement is subject to a weekly mental health psychological exam and relinquishes
their right to filing for a 5150 in cases for the duration of their service. Use of a service
weapon in all cases is considered operating under the color of law. In the event that an
officer fails their psychological evaluation they are immediately relieved of duty for a
minimum of 2 weeks and must be placed under the care of a psychologist or psychiatrist
prior to being reinstated in active service. In order to be reinstated under active service they
must pass a secondary psychological examination but only once given a recommendation on
behalf of their psychologist/psychiatrist.
Section 2 (Citizen Review)
A. A publicly elected citizen review board will operate over the commanding officer of a police
precinct. The Commanding officer must submit their proposed decisions to the review board
prior to directing their department. The citizen review board will hold the final decision on
issues of termination, active duty protocols, and reinstatement of service. The commanding
officer has the right to direct their department against the decision of the review board if the
decision is unconstitutional or goes against state law.
B. The citizen review board will be funded by the municipality in which they operate. Members
of the citizen review board will consist of 9 elected officials and serve in rotating 2 year
terms. There will be no term limits for Citizen review board representatives.
Section 3 (Judicial Processing)
A. Mandatory minimum sentencing may only apply to violent cases and nonviolent offenders
are no longer subject under such sentencing practices
B. Courts that have a higher caseload and in which the ratio of plea deal v. trial is above 80%
may redirect cases to another court’s jurisdiction in which the ratio falls under this limit.
