Dear Governor Bevin,

I am writing to you on behalf of Johnny Phillips. Johnny was convicted in 2009 of wanton murder after a trial that was full of mistakes and withheld evidence. The Commonwealth attorney, Jackie Steele, withheld vital evidence in this case:

·        The first responding officer, Richard Sapcutt, can be heard on the 911 call stating the “victim” was shot in the side of the head, yet Charlie Loomis testified to something completely different

·        Charlie Loomis perjured himself to help get the Commonwealth’s Attorney the indictment he needed to charge Johnny

·        Medical records were withheld and Judge Amul Thapar ordered an evidentiary hearing, in this case, regarding said records

·        Attorney General Andy Beshear’s office, along with Jackie Steele, denied this evidence existed for years and stated Mr. Phillips was on a “fishing expedition”. Only after Mr. Phillips fought for years were these records made available. At this time Andy Beshear’s office took the stance of “it wouldn’t have mattered”. Why didn’t they want Mr. Phillips to have these records? Is it because an expert testified that they showed that Mr. Glodo, in fact, was not shot from behind as the prosecutor asserted? Shouldn’t it be up to a jury to decide if this information was important?

·        DNA testing – at the time of Mr. Phillips’ trial Allison Tunstill was evasive in her answers regarding the match to Mr. Glodo where the knife was concerned. Mr. Steele’s assertion was that Mr. Phillips had shot Mr. Glodo in the back of the head and the knife had been planted. When Judge Tom Jensen ordered for the Commonwealth to turn over ALL DNA lab testing etc. Mr. Steele’s office instructed the Kentucky State Police to only provide Mr. Phillips with partial records and not the complete file. Why after four years has the Kentucky State Police not turned over this information as the court ordered? And what is Mr. Steele and Mr. Beshear afraid Mr. Phillips will find in those records?

·        After Mr. Phillips forensic expert, Larry Dehus requested all forensic evidence, Jackie Steele requested to forfeit and destroy all evidence. Why would Mr. Steele do that when he knew Mr. Phillips was still in his appeals process?

·        Before the trial had even begun Detective Charlie Loomis accessed Mr. Phillips voicemail on his cellphone and deleted threatening voicemails left by Mr. Glodo. Wouldn’t that have been a key piece to Mr. Phillips case? Why would any competent and experience detective delete voicemails that could have helped Mr. Phillips prove that Mr. Glodo had been making threats against his life for an entire day?

·        Why did Robert Stivers, Kentucky Senate President, refuse to look into this case further when his own team stated that “I think this case should be reopened. And “This case is very sketchy and things don’t add up.” After reviewing Mr. Phillips case?

 

This is just the tip of the iceberg and there are far too many questions in this case. Jackie Steele and Andy Beshear’s office doesn’t get to decide what evidence is given to the defense. A piece of evidence that may not “matter” to them may have been a key piece of evidence in a defense attorney’s hands and it may have changed the mind of even one juror sitting on that jury. Under the constitution, we are all, as citizens of the United States, guaranteed a FAIR TRIAL. Mr. Phillips has never received a fair trial. I think if most of us had found ourselves trapped in that dark, church parking lot that night we would have done the same thing Mr. Phillips did. To sentence him to 30 years in prison is a travesty and I, along with countless others, pray that you make this right.
