In April 2015 - Greg Gibbins (Gibbo) and Adam Swindell (Snitch) were stabbed after attending a music festival at the Beachcomber Hotel at Toukley on the NSW Central Coast. Gibbo died as a result of his injuries and Snitch was hospitalised fighting his own battle for life.
Two brothers were charged with the stabbings. Bradley Brooks was charged with murder in regard to Gibbo and the wounding of Snitch, and Joel Brooks with the wounding of Snitch.
Bradley Brooks was bail refused. Joel Brooks was granted bail. In July 2015 Bradley Brooks was granted bail on appeal. The Justice for Gibbo Facebook page was established, a protest rally was organised at the site of the assaults and an online petition obtained more than 10,000 signatures asked for this decision to be overturned. The Court then revoked the bail and Bradley Brooks remained in custody for nearly 2 years awaiting trial. He was convicted this year after a long trial and is now in jail.
The second offender Joel Brooks has been free to get on with his life for 2.5 years and this week, whilst initially being charged with intent to cause grievous bodily harm, pleaded guilty to reckless wounding, a lesser charge.
Yesterday a formal bail hearing granted him bail with sentencing to not take place until 24th September 2018!
This decision is appalling given the gravity of what took place, the fact he has been free for 2.5 years and only now has admitted guilt and now gets an additional 10 months of freedom at minimum. This person has openly admitted to the crime!
Those impacted should not have to wait yet another 10 months to finally be able to begin to try and piece their lives back together. The surviving victim, families, loved ones and the community as a whole deserve a justice system that punishes offenders not rewards them.
All too often we see our justice system give bail to violent offenders only to have them offend again. We live in hope this is not another example. This decision MUST be reviewed.
