Autobell Car Wash has submitted applications for a Special Exception and a Variance from the Town of James Island BZA to be able to build a large car wash at 765 and 761 Folly Road (location of Huffs Seafood and also more recently Pelican's SnoBalls).
We, the undersigned, respectfully ask that the BZA DENY the Special Exception and DENY the Variance requested by Autobell Car Wash to build at this location.
We, the undersigned, feel strongly that the parcel in question is too fragile environmentally to house a large car wash as it borders an inlet of Ellis Creek and also has a beautiful, iconic grand oak on the property (possibly one of the most beautiful grand oaks along Folly Road). To grant a Special Exception to allow for a "Vehicle Services" business in the Commercial Core Area of Folly Road is not justified in this case.
The BZA may only approve a Special Exception per Section 153.045 (E) if they find the following:
(E) Approval criteria.
(1) Special exceptions may be approved only if the Board of Zoning Appeals finds that the proposed use:
(a) Is consistent with the recommendations contained in the Town Comprehensive Plan and the character of the underlying zoning district “purpose and intent;”
**THE FOLLY ROAD OVERLAY ZONING DISTRICT AND RETHINK FOLLY ROAD PLAN ENVISIONS A WALKABLE, BIKABLE FOLLY ROAD AS ITS PURPOSE AND INTENT. A CAR WASH DOES NOT CONFORM TO THAT PURPOSE AND INTENT. SPECIFICALLY THE PURPOSE AND INTENT OF THE FOLLY ROAD OVERLAY IS AS FOLLOWS "to create a corridor that is well-planned and attractive through the implementation of consistent land use and design standards with adjacent jurisdictions and utilizing traffic safety measures and access management for vehicles and pedestrians to ensure safe and efficient traffic movement"
(b) Is compatible with existing uses in the vicinity and will not adversely affect the general welfare or character of the immediate community;
**A CAR WASH AT 765/761 FOLLY ROAD WILL ADVERSELY AFFECT THE CHARACTER AND GENERAL WELFARE OF THE IMMEDIATE COMMUNITY ADDING TRAFFIC, POLLUTION, AND NOISE TO THE IMMEDIATE AREA.
(c) Adequate provision is made for such items as: setbacks, buffering (including fences and/or landscaping) to protect adjacent properties from the possible adverse influence of the proposed use, such as noise, vibration, dust, glare, odor, traffic congestion, and similar factors;
**ALTHOUGH A FENCE MAY BE PART OF THE SITE PLAN, THE NOISE FROM VACUUMS, MACHINERY AND DOZENS OF VEHICLES AT A LARGE CAR WASH ON A >1 ACRE PROPERTY IS NOT BEING PROPERLY MITIGATED AND CANNOT BE IN A BUSINESS THAT WILL OPERATE 12+ HRS A DAY SIX DAYS A WEEK.
(d) Where applicable, will be developed in a way that will preserve and incorporate any important natural features;
**THE OUTSTANDING NATURAL FEATURES OF THIS PROPERTY ARE AN ICONIC GRAND OAK AND A SCENIC CREEK INLET, BOTH OF WHICH MUST BE PRESERVED AND PROTECTED. THE GRAND OAK IS AT RISK FOR DAMAGE DUE TO AUTOBELL'S VARIANCE REQUEST FOR A PAVEMENT ENCROACHMENT OF MORE THAN 25% OF THE CANOPY OF A GRAND TREE AND ALSO DUE TO THE LARGE AMOUNT OF IMPERVIOUS SURFACE AUTOBELL WILL INSTALL AT THE STIE. ADDITIONALLY, DUE TO THE HUNDREDS OF VEHICLES EXITING AND ENTERING THE PROPERTY FOR 12+ HOURS A DAY SIX DAYS A WEEK, THE GRAND TREE IS AT RISK AND THE CREEK IS AT RISK FOR POLLUTION DUE TO POLLUTED RUN-OFF FROM FLOODING
(e) Complies with all applicable rules, regulations, laws, and standards of this chapter, including but not limited to any use conditions, zoning district standards, or site plan review requirements of this chapter; and
**THIS APPLICATION DOES NOT MEET THE STANDARDS FOR THE PURPOSE AND INTENT OF THE FOLLY ROAD OVERLAY WHICH IS INCORPORATED INTO THE TOWN'S ZLDR AND COMPREHENSIVE LAND USE PLAN
(f) Vehicular traffic and pedestrian movement on adjacent roads shall not be hindered or endangered.
**THE SITE PLAN SUBMITTED FOR THE PROPOSED AUTOBELL CAR WASH AT 765/761 FOLLY ROAD WILL OPERATE TO HINDER & ENDANGER TRAFFIC & PEDESTRIAN MOVEMENT ON FOLLY ROAD AND ON NEARBY SIDE STREETS. PEDESTRIANS ON FOLLY ROAD WILL BE ENDANGERED BY THE HUNDREDS OF VEHICLES ENTERING AND EXITING FROM THE PROPERTY 12+ HOURS A DAY SIX DAYS A WEEK. (THE AUTOBELL IN N CHAS OPERATES 7 AM TO 8 PM SIX DAYS A WEEK). VEHICULAR TRAFFIC IS ENDANGERED BY THE HIGH NUMBER OF EXITS AND ENTRIES OF VEHICLES FROM THE PROPERTY, WITHOUT ANY TRAFFIC SIGNAL AT THE LOCATION.
