The age of consent in the Commonwealth of Pennsylvania is 16. This standard is waived, however, if the minor is married to someone older than they are. As age of consent laws exist to protect minors who are unable by virtue of their youth to consent to sex, it is only reasonable that a minimum age for marriage be established as well. While the minimum age of marriage in the Commonwealth is 16, this can be overcome with permission from a parent or a judge "if in the best interest of the minor" (Tit. 23 §1304(1) to (2)).
This petition states that it is never in the best interest for a child to be given over into a sexual relationship when they can not consent to sex.
