Tighten the criteria required for a legal defense to public defecation
Why this petition matters
We call on the New Zealand Government and Ministry of Justice, to change the Summary offences Act section 32.
Section 32 (2) of the summary offences Act provides a legal defense to prosecution for defecating in public, if the pooper had a reasonable expectation they would not be observed.
As most people are offended not by seeing people pooping, but by sighting the visible aftermath, it makes sense to bring the defense criteria in line with worldwide health guidelines and outdoor codes by adding that;
1/ That the poop be buried a minimum of 15cms (a hand length) deep
2/ That any pooping be at least 50 metres (72 steps) from waterways
along with the existing criteria.
Digging a small hole is a very simple task with many implements able to be used to do so.

If the criteria is reviewed, it would also provide an opportunity to enact criteria as to 'where' pooping maybe done (i.e outside urban areas) which does not exist currently.
