Mark Osborne, was found guilty of murder  by joint enterprise on 13th February 2009. The Supreme Court recently ruled this controversial law has been wrongfully interpreted in recent years. Mark has served 13 years of a 30 year sentence for a crime he did not commit.

The case against him relies on the sole testimony of his former cell mate who claimed to have overheard Mark on his mobile phone organising the murder. The cell mate was a desperate and deluded individual who was looking to exploit any avenue he could to avoid deportation. It was just after he received a deportation notice that he claimed to have overheard a conversation by Mark. His subsequent special treatment by the Metroploitan police as a witness lead to his deportation being suspended.  He was a vulnerable individual and the police, who had no other  evidence against Mark, exploited that vulnerability.

This information regarding the witness' mental state, and the call logs on Mark's phone which disproved Witness A's testimony, were not made available to the jury during the trial. Despite contradicting his statements many times, the jury was told that Witness A's statements were consistent.

The prosecution made inadmissible documents that were detrimental to the defence (i.e. unsigned statements) available to the jury, and then ordered them to dismiss it from their minds. It is possible that the CPS intended to influence the jury and negatively colour their view of Mark

The jury was unable to reach a decision and so asked to hear a further summary of Mark's defence, but, as his barrister was out of court, a request was made to adjourn. The judge rejected this request and said he would give a summary, during which he made detrimental and incriminating comments, and refused to give the jury, as requested, a more detailed explanation of what was required of Joint Enterprise to be applicable.

To put it candidly, Mark is a victim of abuse of process.

As a result, he has served 13 years of a 30 year sentence for a crime he did not commit.
