Fail HUD Rule Allowing Homeless Shelter Discrimination Against Gender Identity + Religion

In the spring of 2019, the U.S. Department of Housing and Urban Development proposed a new rule which will allow homeless shelters to “consider a range of factors in making such determinations, including [...] religious beliefs, [...] the individual’s sex as reflected in official government documents, as well as the gender which a person identifies with*.” 

By allowing government-funded shelters to consider of the gender identity and religious beliefs of those seeking shelter, it permits their possible discrimination. Unlike safety or privacy, personal identity and religion does not pose a reasonable security threat to be considered during admission. 

In addition, the LBGT+ community is already disproportionally experiencing homelessness: out of the 1.6 estimated million homeless people in the U.S., 40% identify as LGBT+** despite only consisting of around 4.5% of the total population***. The new HUD rule, Revised Requirements Under Community Planning and Development Housing Programs (FR-6152), could only further put the LGBT+ and especially transgender homeless population at risk.
