WE DEMAND “NOAH’S LAW” BE IMPLEMENTED
We, the undersigned residents of Canada, draw the attention of the House of Commons to the unimaginable and preventable tragedy which took place in Hinton, Alberta on September 16th, 2021 when the double murder of Mchale Erica Busch (age 24) and her son, Noah Lee McConnell (age 16 months) took place. The RCMP have charged Robert Keith Major, age 53, a known sex offender, who has multiple previous convictions, with two counts of second degree homicide and one count of committing an indignity to human remains. The victims and the surviving husband and father, Cody McConnell, had no knowledge that the alleged offender who was, or should have been registered on the National Sex Offender Registry pursuant to the Sex Offender Information Registration Act (SOIRA), was living in the apartment adjacent to their apartment, as the victims had only moved into the apartment complex 10 days prior to facilitate the Cody McConnell’s employment on the TMX pipeline. This was a family apartment complex where children resided and in close proximity to two playgrounds and a school frequented by children. The RCMP allege that the victims were killed in the alleged offender’s apartment.
We respectfully request that Prime Minister Justin Trudeau and the Attorney General of Canada immediately make legislative changes to :
1. The Criminal Code of Canada sentencing provisions for repeat sexual offenders by requiring mandatory minimum sentences for offenders with multiple sexual assault convictions who are designated to be at high risk to reoffend and life long parole;
The National Sex Offender Registry created pursuant to the Sex Offender Information Registration Act (SOIRA) which only allows police to access the database.
Clearly this does not provide for the protection of the public. Convicted sexual offenders who move cities/residency must immediately update the Registry and the general public must be made aware that a registered sex offender is living in their locale by local police authorities.
It is unacceptable to the undersigned that the offender’s potential rehabilitation and reintegration to society is given a higher priority than the lives and safety of their future innocent victims. Every registered owner of any congregate living facility should be given access to having peace officers to search the database for potential tenants.
Further, registered offenders should have to update their personal information, including address and contact information every month and the penalty for failure to do so must include mandatory jail time of at least one year. Public safety must be given preference over potential rehabilitation of convicted sex offenders when the lives and bodily integrity of the innocent are allowed to be placed at high risk in their own homes by these known repeat offenders.
Therefore it is the wish of Cody Lee McConnell’s (spouse/father) that Parliament proceed with urgency to make the changes requested and that Parliament honour Mchale & Noah‘s lives and commemorate their tragic, violent deaths by declaring these changes “Noah’s Law”.
