Many federal laws and benefits are automatically triggered when people marry, where many same-sex or domestic partnership laws do not. If the POTUS is as serious about supporting gay marriage as he was for closing the Guantanamo Bay detention camp, then a great and courageous first step would be to issue an executive order for the IRS to apply all marriage related tax codes to those same-sex couples legally married in States which support it.
If the IRS can make an acceptation for Massachusetts to get an extra day to turn-in their taxes when their State holiday (Patriots’ Day) falls on April 15, then it can recognize Massachusetts sanctioned marriage.
IRS rules like allowing spouses to contribute to an IRA even if they are not employed, mandating that your only your spouse may be the primary beneficiary of a 401(k) plan, and a right to receive 1/2 of an ex/deceased spouse’s SS retirement checks.
President Obama may not be able to push a full blown same-sex marriage bill through congress (they shouldn’t be allowed to mess thing up more), but he can demand that his agencies and departments within the executive branch, apply their rules and regulations fairly to those couples that have won the right to same-sex marriage within their states.
