Stop selling the state estates immediately! Ensure the land rights of the up-country people!

A Cabinet decision was taken on 2021.9.06th to release 811 acres of land belonged to the Mount jean and Galaboda Estates maintained by the JEDB where estate people live to Farm’s Pride (Pvt) Ltd, 200 acres of land belonged to Delthota Estate and 150 acres of land belonged to Great Valley Estate to Hillside Agro (Pvt), 700 acres of farm land in Nikawarettiya belonged to NLDB to H.B.K.I.R International Investment/Access Agro (Pvt) Ltd and 60 acres of land from the same farm to Pesara Logistics, 250 acres of farm land in Kotukachchi belonged to NLDB to Gamma Pizzakraft (Pvt) Ltd for 30 years lease for setting up farms to promote local milk production. The hill country people who have been living in this soil for more than 200 years have been denied their land, political, social and economic rights and these people like other communities have a genuine feeling that this country is their mother land. The land where they have lived to date is their land of existence, their identity, their base for livelihood, resources and cultural existence. It is crucial in any democratic country that development plan in an area should be initiated with the consent of the people live in the respective area. Implementing any project or program without obtaining the consent and inputs of the people of the respective area or their representatives is a violation of democratic values. In a situation when people cannot express their opposition because of the emergency law currently in place, implementing such decisions is a violation of human rights. In the long term such moves will lead to the plundering of the resources of the country by the multi-national companies, weakening of the economy of the country and exploitation of the labor of our workers. Thousands of hill country people live in these estates. The life style, livelihood and identities of these people are deeply rooted in this soil. Therefore, selling these lands to foreign companies or leasing will deprive these people of their lands and livelihoods. Especially, many workers from Janatha Estate Development Board (JEDB) and Sri Lanka State Plantation Corporation (SLSPC) have already lost their livelihood and their EPF, ETF and Service gratuity including other statutory payments have not been paid to them. Previous governments also attempted to increase the milk production of the country by importing milch cows. But the attempts became futile due to biological and environmental unsuitability.

Therefore, implementing projects with less feasibility should be stopped and projects that have detrimental effect on the land rights and the livelihoods of the estate workers and hill country eco systems should be stopped. Instead, small scale environmentally friendly mixed cultivation methods and livestock development projects should be initiated prioritizing the estate workers. This will contribute to the economy of the country. President Gotabaya Rajapakse has said in his election manifesto that “it will be ensured that the rights of the strategic assets and natural resources of economic importance are not transferred to any foreign country. But the government is engaged in activities contrary to this pledge. We vehemently condemn and criticize the activities of the government ignoring the interest of the people and thus propose the following demands to protect the resources of the estate workers who live there and contribute their sweat and labor to the upliftment of the economy of this country and to protect the resources of this country.

01. Stop immediately the decision to give the estate lands which have given livelihood for four generations to the private sectors and multi-national companies.

02. In order to ensure housing, livelihood and cultural identity of the legal occupants living in these estates, land entitlement for 20 perches be ensured for each family.

03. Implement the initiative to distribute the uncultivated 37000 hectares of land for cultivation purposes to the estate workers as proposed in the budgets of 2012 and 2013 by the Prime Minister Mahinda Rajapakse. Provide necessary support to the estate workers to engage in environmentally friendly tea cultivation, mixed cultivation and livestock rearing for milk production.

04. Develop an integrated and sustainable development project for the estates based on water sources and eco system considering the whole hill country as an environmental system.

05. Instead of implementing unsustainable projects using imported expensive milch cows, start small scale and medium scale milk farms for farmers and estate workers integrated with environmentally friendly agriculture.

06. The workers of the estates maintained by the JEDB and SLSPC have not been paid EPF, ETF,Gratuity and other social security payments amounting to millions of rupees since 2014 and many workers have retired without obtaining these benefits. These payments should be paid immediately.

07. Stop immediately the gem mining activities, deforestation and degradation of water sources causing serious environmental and social destruction in the estates.

பெருந்தோட்ட மக்கள் வாழுகின்ற மக்கள் தோட்ட அபிவிருத்தி சபை (JEDB) நிறுவனத்தால்  நிர்வகிக்கப்படுகின் மவுண்ஜீன் மற்றும் கலபொட தோட்டங்களில் உள்ள 811 ஏக்கர் காணிகளை Farm’s Pride (Pvt) Ltd நிறுவனத்திற்கும், தெல்தோட்ட மற்றும் கிரேட்வெளி தோட்டங்களில் உள்ள முறையே 200 மற்றும் 150 ஏக்கர் காணிகளை (350 ஏக்கர்) Hillside Agro (Pvt) Ltd நிறுவனத்திற்கும், தேசிய கால்நடை அபிவிருத்தி சபைக்கு (NLDB) சொந்தமான, நிக்கவரெட்டிய பண்ணையில் உள்ள 700 ஏக்கர் காணியை H.B.K.I.R International Investment/Access Agro (Pvt) Ltd, இதே பண்ணையில் உள்ள 60 ஏக்கர் காணியை Pesara Logistics நிறுவனத்திற்கும், கொட்டுக்கச ;சிய தேசிய கால்நடை அபிவிருத்தி சபைக்கு (NLDB) சொந்தமான பண்ணையில் உள்ள 250 ஏக்கர் காணியை Gamma Pizzakraft (Pvt) Ltd தனியார் கம்பனிக்கும் முறையே 30 வருடகால குத்தகைக்கு உள்நாட்டு பால் உற்பத்தியை ஊக்குவிப்பதற்கான பண்ணைகளை அமைப்பதற்காக வழங்க அமைச்சரவையில் 2021.09.06 ஆம் திகதி தீர்மானிக்கப்பட்டுள்ளது. 200 வருடங்களுக்கு மேல் இம்மண்ணில் வாழ்ந்து வரும் மலையக மக்களுக்கு காணி, அரசியல், சமூக, பொருளாதார மற்றும் அபிவிருத்திக்கான உரிமைகள் மறுக்கப்பட்டு வருவதுடன், ஏனைய சமுதாயங்களைப் போன்று இவர்களும் இது தங்களது தாய் நாடு என்பதை உணர்கின்றனர். இதுவரை வாழ்ந்த மண்தான் இம்மக்களின் வாழ்விடம் , அடையாளம் , வாழ்வாதாரதிற்கான வளங்கள், பண்பாட்டு இருப்பு என்பவற்றுக்கு அடித்தளமாக விளங்குகின்றது. ஒரு ஜனநாயக நாட்டில் குறிப்பட்ட பிரதேசத்தில் வாழும் மக்களின் விருப்புக்கு இணங்கவே திட்டங்களை முன்னேடுக்க வேண்டும். ஆயினும், மேற்குறிப்பிட்ட பிரதேசங்களில் வாழும் மக்களின் அல்லது மக்கள் பிரதிநிதிகளின் ஆலோசனைகள் எதுவும் பெறப்படாது இவ்வாறான திட்டங்களை மேற்கொள்வது அடிப்படை ஜனநாயக விழுமியங்களுக்கு முரணானது. மேலும் அவசரகாலச் சட்டம் நடைமுறையில் உள்ள சூழலில் மக்களின் எதிர்பினை வெளிப்படுத்த முடியாத நிலையில் இவ்வாறான தீர்மானங்கள் மேற்கொள்ளப்படுவது மனித உரிமை மீறலாகும்.

இத்தோட்டங்களில் ஆயிரக்கணக்கான தோட்டத் தொழிலாளர்கள் வாழ்ந்து வருவதோடு அவர்களின் வாழ்க்கை முறை, வாழ்வாதாரம் மற்றும் அடையாளங்கள் ஆகிய அனைத்தும் இக் காணிகளின் மீதே அடிப்படையாக அமைந்துள்ளன. இக்காணிகளை வெளிநாட்டுக் கம்பெனிகளுக்கு விற்பனை செய்தல் அல்லது குத்தகை அடிப்படையில் வழங்குவதன் மூலம் இந்த மக்கள் தமது காணிகளையும் வாழ்வாதாரங்களையும் இழக்கும் அபாயத்தினை எதிர்நோக்குவர். குறிப்பாக, மக்கள் தோட்ட அபிவிருத்தி சபை மற்றும் இலங்கை அரச பெருந்தோட்டக் கூட்டுத்தாபனம் போன்ற அரச நிறுவனங்களுக்குச் சொந்தமாகவிருந ;த தோட்டங்களில் பணியாற்றிய பெரும் எண்ணிக்கையிலான தொழிலாளர்கள் ஏற்கனவே தமது வாழ்வாதாரங்களை இழந்துள்ளதோடு அவர்களுக்கு செலுத்தப்பட வேண்டிய ஊழியர் சேமலாப நிதி உள்ளிட்ட ஏனைய செலுத்தல்கள மேற்கொள்ளப்படுவது தொடர்ந்தும் புறக்கணிக்கப்பட்டு வருகின்றது. வெளிநாடுகளிலிருந்து த தருவிக்கப்படுகினற கறவை மாடுகளைப் பயன்படுத்தி இலங்கையில் பால் உற்பத்தியை அதிகரிக்கச ; செய்வதற்கான கருத்திட்டங்கள் இதற்கு முன்னைய அரசாங்கங்களினாலும் ஆரம்பிக்கப்படுவதற்கு முயற்சிகள் மேற்கொள்ளப்ப்பட்டபோதிலும் பல்வேறுபட்ட உயிரியல் ரீதியானதும் சுற்றாடல் ரீதியானதுமான பொருத்தமற்ற தன்மைகளின் காரணமாக அக் கருத்திட்டங்கள் தோல்வியடைந்தன. எனவே, மீண்டுமொருமுறை தோல்வி அடையக்கூடிய கருத்திட்டங்களுக்குப் பதிலாக ஆயிரக்கணக்கான தோட்டத் தொழிலாளர்களின் காணி உரிமை, வாழ்வாதாரங்கள் மற்றும் மலைநாட்டு சுற்றாடல் முறைமை அழிக்கப்படுகின்ற திட்டங்களைக் கைவிட்டு தோட்டத் தொழிலாளர்களைமுதலாகக் கொண்ட சிறிய அளவிலான சுற்றாடல் நேய கலப்புப் பயிர்ச்செய்கை மற்றும் மிருகவளர்ப்புக் கருத்திட்டங்களை ஆரம்பிப்பதன் மூலம் நாட்டின் பொருளாதாரத்திற்கு அதிக பலமிக்கதும்நிலைபேறானதுமான பங்களிப்பினை வழங்குவதற்கு நடவடிக்கை எடுக்குமாறு நாம் அரசாங்கத்திற்கு முன்மொழிகின் றோம்.

01. நான்கு பரம்பரைகளுக்கு தமது வாழ்வாதார இருப்பினை பெற்றுத்தந்த தோட்டக்காணிகளை தனியார் துறைக்கும் பல்தேசிய கம்பெனிகளுக்கும் வழங்குவதற்கு அரசாங்கம் மேற்கொண்டுள்ள தீர்மானத்தை உடனடியாக நிறுத்துதல்.

02. குறிப்பிட்ட தோட்டங்களில் வாழும் மக்களின் வீடமைப்பு, வாழ்வாதாரம் மற்றும் அடையாளம் உறுதிப்படுத்தப்படுகின்ற வகையில் ஒரு குடும்பத்துக்கு தலா 20 பேச்சஸ் காணியின்  நிரந்தர உரிமையை உறுதிப்படுத்துதல்.

03. இன்றைய பிரதமர் மஹிந்த ராஜபக்ஷ அவர்களினால் 2012 மற்றும் 2013 ஆகிய ஆண்டுகளுக்கான வரவு செலவுத் திட்டங்களை முன்வைத்து தெரிவித்த வகையில் பெருந்தோட்டப் பகுதிகளில் தற்போது பயிரிடப்படாமல் காணப்படுகின்ற சுமார் 37,000 ஹெக்டயர் காணிகளை உற்பத்தி நடவடிக்கைகளை மேற்கொள்வதற்காக தோட்ட மக்களுக்குப் பகிர்தளிப்பதற்கான முன்மொழிவினை நடைமுறைப்படுத ;துதல். இக் காணிகளை அண்டியதாக, கூட்டுறவு முறையின் அடிப்படையில் சுற்றாடல் நேய தேயிலை மற்றும் கலப்புப் பயிர்ச் செய்கையையும், பால் உற்பத்தியை முதலாகக் கொண்ட மிருக வளர்ப்பினையும் மேற்கொள்வதற்கு தோட்டத் தொழிலாளர்களுக்குத் தேவையான ஆதரவினை வழங்குதல்.

04. ஒட்டுமொத்த மலைநாட்டினையும் ஒரு சுற்றாடல் முறைமையாகக் கருதி நீர் மூலாதாரங்கள் மற்றும் சுற்றாடல் முறைமைகளை அடிப்படையாகக்கொண்ட ஒருங்கிணைந்த நிலைபேறான அபிவிருத்தித்திட்டமொன்றை தோட்டங்களுக்கென உருவாக்குதல்.

05. பால் உற்பத்தியை மேம்படுத்துவதற்காக அதிக செலவினத்தைக் கொண்ட வெளிநாட்டு கறவை மாடுகள் பயன்படுத்தப்படும் நிலைபேறான தன்மையற்ற கருத்திட்டங்களுக்குப் பதிலாக தோட்டத் தொழிலாளர்கள் மற்றும் விவசாயிகளை அடிப்படையாகக்கொண்ட சுற்றாடல் விவசாயத்துடன் ஒருங்கிணைந்த சிறிய மற்றும் நடுத்தர அளவிலான பால் பண்ணைகளை ஆரம்பித்தல்.

06. மக்கள் தோட்ட அபிவிருத்தி சபை மற்றும் இலங்கை அரச பெருந்தோட்டக் கூட்டுத்தாபனம் போன்ற அரச நிறுவனங்களினால் நிர்வகிக்கப்படுகின்ற தோட்டங்களில் பணி புரிகின்ற தொழிலாளர்களுக்கும் தற்போது ஓய்வுபெற்றுள்ள தொழிலாளர்களுக்கும் கிடைக்கப்பட வேண்டிய ஊழியர் சேமலாப நிதி, ஊழியர் நம்பிக்கைப் பொறுப்பு நிதி, பணிக்கொடை மற்றும் ஏனைய சமூக பாதுகாப்புக் கொடுப்பனவுகளை உடனடியாக செலுத்துவதற்கு நடவடிக்கை எடுத்தல்.

07. தோட்டப் புறங்களில் பாரியளவிலான சுற்றாடல் மற்றும் சமூக பாதிப்புகள் ஏற்படும் வகையில் ஆரம்பிக்கப்பட்டுள்ள இரத்தினக்கல் அகழ்வு, காடழிப்பு, நீர் மூலங்கள் அழிவடையும் வகையில் மேற்கொள்ளப்பட்டு வரும் கருத்திட்டங்கள் என்பவற்றை உடனடியாக நிறுத்துதல்.

එබිවින් අප රජයට බයෝජනා කරන්බන් නිවත වරක් අසාර්ථක විමට බයෝිත වයාපෘති බවනුබවන් වතු කම්කරුවන් ෙහස් ගණනකබේ ඉඩම් අයිතිය, ජීවබනෝපායන් හා කදුකර පරිසර පද්ධතීන් විනාශ කරන සිළසුම් බවනුවට, බමම වතුකම්කරුවන් මුල වූ සුළු පරිමාණ පරිසර හිතකාමි මිශ්‍ර බබෝග හා සත්ව පාලන වයාපෘතින් ආරම්ක කිරිරිම තුළින් රබට් ව ආර්ිකයට වඩා ශක්තිමත් හා තිරසාර ොයකත්වයක් ලබා දීමට පියවර ගන්නා බලසයි.

01. පරම්පරා හතරකට තම ජීවන පිවිත්ම බගන දුන් වතුකර ඉඩම් බපෞද්ග ක හා බහුජාතික සමාගම්වලට පිවමමට රජය බගන තති තීරණය වහාම අත්හිුීම

02. අොල වතුයායන්හි ජීවත්වන ජනාතාවබේ නිවාස, ජීවබනෝපාය සහ අනයනයතාවය තහවුරු වන පරිදි පවුලකට පර්චක් 20 ඉඩමක ස්ීර අයිතිය තහවුරු කර දීම.

03. වර්තාමන අග්‍රාමාතය මහින්ෙ රාජපක්ෂ මහතා විසින් 2012 සහ 2013 අයවිය බයෝජනා ඉදිරිපත් කරමින් ප්‍රකශ කළ පරිදි වතුකරබේ ෙිනට පවතින බහක්ටයාර 37,000 කට ආසන්න වගා බනාකරන ලෙ ඉඩම් වතුකර ජනතාවට නිෂ්පාෙන කටයුතු සෙහා බබොදීබම් බයෝජනාව ක්‍රියාත්මක කිරිම. බමම ඉඩම් ආ තව සමුපකාර මය මත පෙනම්ව පරිසර හිතකාමි බත් සහ මිශ්‍ර බබෝග වගාවත්, කිරි නිෂ්පාෙනය මුල කර ගත් සත්ව පාලනයත් ක්‍රියාත්මක කිරිම සෙහා වතු කම්කරුවන්ට අවශය සහාය ලබා දීම.

04. සමස්ත කදුකරය එක් පරිසර පද්ධතියක් බලස සලකමින් ජල මූලාශ්‍ර හා පරිසරි පද්ධතීන් පෙනම් කර ගත් ඒකාබද්ධ තිරසර සංවර්ධන සිලිස්මක් වතුකරය සෙහා බගාඩනිංීම

05. කිරි නිෂ්පාෙනය ඉහල ෙිමීම සෙහා වියෙම් අධික විබද්ශීය කිරි ගවයන් බයාො ගන්නා තිරසාර බනාවන වයාපෘති බවනුවට වතු කම්කරුවන් හා බගාීන් මුල කර ගත් පාරිසරික කෘකරකර්මය හා ඒකාබද්ධ වූ සුළු හා මධය පරිමාණ කිරි බගාවිපලවල ආරම්ක කිරිම.

06. ජනතා වතු සංවර්ධන මණ්ඩලය හා ලංකා රාජය විවි සංස්ථාව විනි රාජය ආයතන මගින් පාලනය කරන වතුවල බස්වය කරන හා ෙිනට විශ්‍රාම බගන සිටින වතුකම්ැදවන්ට හිමිවිය යුතු බස්වක අර්ථසාධක අරමුෙල, බස්වක කාරකාර අරමුෙල, පාරිබතෝකරක හා අබනකුත් සමාජ ආරක්ෂණ දීමනා වහාම බගීමට කටයුතු කිරිම

07. වතුකරය තුළ විශාල පාරිසරික හා සමාජ හානි සිදුවන අයුරින් ආරම්ක බකාට තති මිණික් ගිමම, වන විනාශාය, ජල මූලාශ විනාශ වන අයුරින් සිදුකරන වයාපෘති වහාම නතර කිරිම.
