Support Shared Parenting / Joint Custody To Bring Reforms in Outdated Law Related to Child Custody & Visitation

The numbers of divorce cases are rising, resulting in rise of bitter child custody battles. 

Often, the innocent children are used as tools of vengeance by vindictive litigants who inflict severe emotional and psychological abuse on the child thereby seriously affecting the child in his/her later part of child’s life.

In family disputes, litigants often make false and vindictive allegations against each other, wasting & consuming enormous court’s time which can be reduced considerably.

Depriving love & affection of both parents, more particularly due to alienation of the child by the custodial parent and or denial of proper access to the non-custodial parent by the courts has proven to result in serious consequences caused in the later part of the child’s life such as drug abuse, deteriorating educational achievement, premature sexuality, mental/personality disorder, chronic depression, suicidal tendency, out of wed-lock birth, which are often a major force behind serious crimes. This issue needs immediate attention.

Law Commission of India has taken initiative for shared parenting / joint custody in the larger interest and welfare of the children to ensure them love & affection of both parents.

This is indeed a welcome move and This Petition is in support of the same.

Shared Parenting Law is much needed reform for the well being of the large number of children from broken family.

There is a significant co-relation between the amount of time spent by the non-custodial parent and the bonding, hence psychological well-being of the child.

Research states that : Children in shared care arrangements reported positive benefits indeed, a number of the children who were not in shared care wanted more time with their non-custodial parent. 

Children need both parents responsibly involved in their lives.

The loss of relationship between the child and the non-custodial parent needs to be re-stored through shared parenting / joint custody arrangements.

Statistics also state that children from a single parent home are:

more likely to commit suicide.

more likely to run away.

more likely to have behavioral disorders.

more likely to commit rape

more likely to drop out of high school.

more likely to abuse chemical substances.

more likely to end up in a state-operated institution.

more likely to end up in prison

There are  many children who are losing their parent every single day due to the absence of Shared Parenting Law. 

There is a Loss of Parent-Child Relationship which needs to be protected immediately.

This petition is to support initiative of Shared Parenting / Joint Custody and to ensure children of our nation with love and affection of Both Parents.
