With the current legislation, whoever 'gets in first' in taking out a police family violence order is believed to be the victim and receive the police support.

The complainant does not need to provide ANY evidence or proof, they simply need to say that they feel their safety is at risk and they will be granted a Police Family Violence Order.

Once the order is in place, the defendant can be arrested for any reported breach, even WITHOUT proof. They can also be forced to wear an electronic monitoring ankle bracelet, which prevents one from going within 1km of restricted addresses and allows police to monitor their location in real time using GPS. They can have harsh curfews imposed which restricts one's movements and allows police to check up on them at any hour of the night. Effectively this means the person is treated as GUILTY UNTIL PROVEN INNOCENT.

This is a fallacy and these laws must be changed so that people cannot use them as a weapon against others.

These types of crimes need to be treated as all others. There needs to be proof.

People should not be arrested and thrown into a cell based on allegations.

This is ruining people's lives and is all too common.
