Dear President Ramaphosa, I write to you in the wake of Former President Zuma's arrest following the Constitutional Court order by Acting Judge Sisi Kampepe.

Former President Jacob Zuma is a South African freedom fighter who is 79 years of age and sickly. He was sentenced to 15 months in jail  for contempt of Court by the Constitutional Court of South Africa for not continuing to appear before the Zondo Commission. He has been detained without trial and without an option to appeal as the case was heard at the apex court of the land.

During this period, our country is on lockdown due to Covid-19 which has different variants that some are still undetected on how they mutate. Detaining an elderly will lead him to exposure to this deadly virus with its multiple variants.

Section 84(2)(j) of the South African Constitution sets out the President's powers. This means, as the President of this country, you have the discretion on how you exercise powers to pardon or reprieve offenders. Pardons are your prerogative.

Coming to our laws, I trust and respect them. However, I feel the Constitutional Court erred by accepting to hear a matter while a similar matter had been filed with the High Court to review Judge Zondo's refusal to recuse himself. I also think the appropriate sentence would have been a suspended sentence and/or with a fine as a first offender and also taking the detainee's age into consideration.

Detaining an elderly person will not assist in our immediate problems as a country.
I believe that the Constitution is meant to protect us, as a people, and that it's through us, the people that the Constitution lives.

I therefore appeal to you Mr Ramaphosa, as the President of the Republic to please give former President Zuma a Presidential Pardon immediately as this prerogative is set out in the Constitution and is vested in the President of The Republic of South Africa.
