AG: Investigate DNC

Dear Attorney General Karl Racine of Washington DC and Attorney General of New York Eric T. Schneiderman;

We The People, signatories of this petition, submit complaint to the nonprofit division of the Attorney Generals Office, of the non-profit Democratic National Committee (DNC).  The DNC has broken the public's trust as a non-profit, and we see seek a monetary and restructuring redress of the non-profit.

In dismissing a case against the Democratic National Committee yesterday, Senior United States District Judge William J. Zloch stated in his Order that,

"Through its Charter and Bylaws, the DNC has obliged itself to a policy of neutrality among Democratic presidential candidates. To that end, as it pertains to the Presidential nominating process, the Chairperson shall exercise impartiality and
evenhandedness as between Presidential candidates and campaigns.The Chairperson shall be responsible for ensuring that the national officers and staff of the Democratic National Committee maintain impartiality and evenhandedness during the Democratic Party Presidential nominating process.” DE 8, ¶ 159 (emphasis supplied in Complaint). Wasserman Schultz and other DNC officials touted this policy in public statements during presidential primaries."

The plaintiffs in this case, ordinary citizens who expressed their undying commitment to our democratic processes by donating their hard-earned money to candidate Bernie Sanders, brought forth factual evidence that DNC office holders had stated during the primary process that:

1) “I count Secretary Clinton and Vice President
Biden as dear friends, but no matter who
comprises the field of candidates it’s my job to
run a neutral primary process and that’s what I
am committed to doing.”
• “the DNC runs an impartial primary process.”
• “the DNC runs an impartial primary process,
period.”
• “the Democratic National Committee remains
neutral in this primary, based on our rules.”
• “even though Senator Sanders has endorsed my
opponent, I remain, as I have been from the
beginning, neutral in the presidential Democratic
primary.”

The court found that the plaintiffs had shown sufficient evidence for it to find that:

1) The DNC and Wasserman Schultz preferred Hillary Clinton as the Democratic
candidate for president over Bernie Sanders or any other Democratic
candidate;

2) That they stockpiled information useful to the Clinton campaign;

3) They devoted their resources to assist Clinton in securing the party’s nomination and opposing other Democratic candidates;

4) They engaged in these surreptitious acts while publically proclaiming they were
completely neutral, fair, and impartial.

 

Despite all of this, the Court found that the named Plaintiffs did not
present a case that is cognizable in federal court.

That is why we turn to YOU now Attorney General Racine!

We, the undersigned, consider you to be one of the most important leaders in the fight for HONEST GOVERNMENT.  

We, the undersigned, believe that the manner by which the DNC conducted itself in the primary process does indeed effect the public's interest in honest government. We, the undersigned, do believe that your Office has the authority to conduct an investigation into this matter.  In fact, a Southern District of New York judge (in the matter of Kurzon v. DNC) found that the plaintiff had standing.  And so, in keeping with that decision, this Office has the right to investigate matters concerning the primary process which occurred in New York State as New York State is responsible for funding the mechanisms of that process.

A formal complaint will be delivered to your office, along with this petition.

Thus, in finality, WE the undersigned urge you to open an investigation into this matter and help restore the people's faith in democracy and justice.
